So I have quick question:

Is it actually ok to submit N-400 with ROC pending? Lady that helps me to fill out forms (she is a notary) said that it’s a waste of money and I should wait for 10 year green card and only after I receive it submit N-400. But I see a lot of people are actually doing it here... will that cause any problems? And another thing. My extension and first GC expires in April. Can I apply now Since I’m Feb 2017 filer? Or wait till April?

thanks for replies guys

You can apply 90 days a year after the anniversary of conditional card. (if you are married). In other words, three years after the start of your conditional GC, minus 90 days. Your lady friend is wrong!  And Im having a rest, my brain is just not functioning right now, as I had to keep editing my comments.

Yes, it is slim, even if you are a divorce waiver or came over on a different visa, but chances are a tad higher and they have to be seen to interviewing a certain quota.  As for stopping in London in this political climate that doesn't really matter. I will tell you why, my cousins husband they live in London from England is a journalist and because he travels with work to certain places they wouldnt allow him an ESTA. He had to apply for a B2 or whatever its called and just because he worked abroad.

I had a similar case. A friend of mine from Europe had his ESTA denied because he holds more than one passport. He's been to the US many times under the Visa Waiver program and he was planning a trip to the US this year. The ESTA is only valid for 2 years and his travel authorization had expired. When he went online to renew it the questions had changed. Now he has to apply for a tourist visa in France. The cost for a B2 visa is about 160 dollars. It's preposterous.

Yes they are adjudicated together but you cannot get N400 without first a successful i751.

I've heard when they are adjudicated together they don't even print the card. Does that mean if you fail the test they start printing your card?

I'm talking about failing the citizenship test. If failing the citizenship test means you fail ROC then it's not worth filing N-400 till after ROC had been adjudicated.

Your ROC will first be determined before the citizenship. It's a 2 in 1 interview.

That is a tricky one that I haven't had experience with but whether your citizenship is denied you still have permanent legal status. So i would imagine if you fail i751 you won't get on to n400. however, if your n400 is denied your i751 could still be approved as you won't lose your permanent resident status.

Is it possible to have ROC adjudicated months before N-400? Or will they always pair them together?

I would say most of the times it will be a combo. When you file for N-400 with a pending I-751 they send your I-751 to your local field office. The field office considers it convenient to take both interviews on the same day and save USCIS some dollars for not producing the greed card    USCIS believes at this point that the applicant ultimate goal is citizenship so there is no need to produce a GC.

But they have to also consider the applicant could fail the test. Also it's like they use the N-400 application to delay the ROC. It'd be nice to have that new GC in hand this year. MN office is slow with N400.

Well, the overwhelming majority of the applicants pass the naturalization test. Failing a test is a possibility but it wouldn't affect the ROC. In most cases when you file for naturalization with a pending I-751 it doesn't delay the process it might but in some instances. Did you file for naturalization my friend?

If you're worried about the N400 interview if the i751 is adjudicated successfully and the n400 is failed/pending you can always get a i551 stamp as you are a permanent resident.
