Again, wills will help you.  They're good for life regardless of immigration considering your wife's name is not on the home.  Medical powers of attorney for both of you and over your son for you since you're not his biological parent.   Again, good for life regardless of immigration!  I'm surprised your mother who you said is an attorney (of what I'm not sure though) has not mentioned either of these to you before.

I spoke to an immigration attorney as suggested by Joanna. It went very well. He assured me 1) that my situation is not that unusual and 2) that the other evidence in our packet is very convincing. He said he was not concerned at all. 

Thank goodness.
