Help! some questions about i485

Hi, I came to the US under a k1 visa, which expires march 23, 2017. My fiance and I are getting married feb 12, I just have a few questions before I mail our application in.

 

1) When submitting the form, do I have to send in evidence of our relationship, or just a copy of our marriage certificate? 

2) Im also filling out work authorization with it, I have to submit both fees, correct? the 1140, 85 for biometric, and 410 for EAD? I read that I wouldnt have to pay the EAD fee if I file them together, but I am not sure.

Certified copy of you marriage certificate will suffice. If you file I-765 and I-131 with the I-485 petition, you only have to pay the I-485 fees. $1225

Yes send evidence of your marriage joint bank accounts etc. 

If you file the ead along with your application you don't have to pay the additional fee.

Ditto what Dutchster said. Your marriage certificate is enough for the 485, and you don't have to pay fees on the other forms if you file everything concurrently with the AOS.

As it is 2 -1 on the evidence or not, Let me clarify the reasoning.

 

One group states:

Follow the instructions on the forms they are leading ==> you only sent the certificate.

 

The other group states

If you front load an I-485, it will help the approval changes, they choose to include additional evidence of marriage.

 

No one knows if it helps or not and you should not be denied for not providing it.

 

When I sent in mine, I included some things I happen to have laying around (car title, insurance, retirement benefits) It wasn't a lot of paper and I figured it would not hurt.

 

In the end I got approved without an interview, but so have people that did not include any evidence.

 

So do what you feel comfortable with.

Hi, so I'm a little bit worried because our lawyer told us that the payment for adjustments of status is $1140 and he asked for additional 70$ with this the total will be $1210 and upon reading your comments im sure there's possibility that our payments will not be accepted

This is confusing advice from the lawyer.  The AOS fee is $1,140 and the biometrics fee is $85 (not $70) which means $1,225 (I765 and I131 fees are waived when filing concurrently).  I think they may reject your package for incorrect filing fee if you only sent $1,210.  I would do a search for "incorrect filing fees" here on VJ, or via Google as there may be some current topics considering the fees recently changed in December.

 

As to adding additional information, I echo Fr8dog in his response.  The added evidence is not officially necessary at the I485 stage, but many include it, and no one knows if this helps or not.  You will need a lot of additional evidence when you file for ROC (I751) in a few years.

We sent a copy of our marriage certificate, husband's 1040 (taxes) for the past 3 years, a copy of his birth certificate and copies of both our passports. Everything else we brought it at the interview. If you already have the evidence I would say, send it, otherwise just bring it to the interview, you should be fine. Regarding the filing fees, it's best to go by the official USCIS.gov website to verify you have included what they require.

Day 09 -  12/20/2018 - Called USCIS gave my alien# and they confirmed the package was received. within the hour I got a text message with my case number

Day 22 - 01/02/2019 - Received NOA Letter on the mail extends GC for 18 months. idk the exact date  I got it on the mail because I didn't write it down right away, this is when I scanned it. Notice date says Dec 19

Day 191 - 6/20/2019 - Called USCIS gave my alien# and asked for update 15 to 19 months  (March 2020 - August 2020) from filing date
