Traveling with Spouse CR1 Visa

Quick question.  I filed for my husband whom is here with me in the United States for a CR1 Visa.  I am sure I am not the only case like this but I have not read anywhere that the person applying for the Visa is in the United States.  So my question we are currently awaiting to be given an interview date my idea is to travel with my husband to El Salvador and to stick with him throughout this process.  However I am seeing that some individuals are not getting their Visa when they were told that they were going to get it.  Has anyone traveled with their spouse and accompanied him/her to the interview?

Not entirely sure what you're asking. Can people be rejected for an IR1/CR1 visa after an interview? Absolutely. Do some people get placed on administrative processing (i.e., neither approved or denied) and have to wait for long periods before the visa is issued? This can certainly happen as well. 

 

Are you a US citizen? In theory, they should allow you into the embassy, but they may or may not allow you to accompany your husband all the way to the interview window. Some embassies/consulates allow it, others do not. It might best to email/call the embassy ahead of time and ask if you can accompany your husband. There are many stories on VisaJourney where the US Citizen Spouse appearing for the interview is viewed in a positive manner, i.e., as proof of a bonafide marriage.

Is your husband with you now on a tourist visa, and is just waiting to fly back to El Salvador once you are scheduled for an interview?  I'm just wondering how that would be perceived by the embassy.  Regardless, yes, it is best to accompany your spouse to the embassy for the interview.  Although in most cases this is not required, it is certainly recommended.

7/27/2023: Both cases sent to NVC

So actually my husband entered unlawfully and we have done the whole process in validating marriage and petitioning that I need him to be in the states.  So he is here with nothing.  We have done all the paper work with an attorney.  I guess that is my real concern as I see everyone here is either over in their country and their spouse/fiancé is in the states versus us that we are both here.  I am a US citizen born and raised here.

Yes, I think for most people (including my case), one spouse is in the home country and the other is in the US.  I've seen other cases where both persons are living outside the US.  Regardless, I think you both should go to the interview seeing that he entered unlawfully.  As with any case, I would suggest taking as much evidence as possible to show a bona fide marriage.

Thank you Ducan21 for your insight on this.  This is my first and hopefully last time that I have to do this so I am extremely nervous.  We hope to get in interview date for March so I just want to make sure I am mentally prepared for anything and that I take all of the correct paperwork.  I am super detailed and organized in our paper work thus far.  Also, we do have an 18 month old daughter so just trying to get ready to take this on.

Let us know when you receive your interview date.  Many of us who got case complete in January are waiting for a March interview date - hopefully we find out within the next week.

So the same with my husband. I did not accompany him because it states on the interview paper that it was not required and that i would not be allowed in anyway. El Salvador is horrible with their timing. He's been there for 2 months now after he was approved for the interview on 12/29. 1/3 they sent an email that they needed more info he sent it and they received it on the 9th. Just yesterday the dates changed and again today but still in admin processing. 21 days since the last date change. Hoping this means they are looking at it.

Oh man.  Well I will go with my husband just to accompany him throughout this process but I do have a full time job and if we take our daughter we cant be there a whole two months.  What did they ask for if you don't mind me asking.  I hope he gets home to you soon! :(

He was told to get his police clearance form from El Salvador prior to the interview and he did. The officer at the embassy never asked for it. She gave him a paper that said he was appproved and that he would have his visa in 1-2 weeks. After the new year holiday we got an email that under 221g his case is on hold until he submits court docs for an arrest 9 years ago in El Salvador. He was never convicted or tried. And it has been closed. What's frustrating is that it didn't show up on his police clearance form and when NVC did his background check prior to the interview nothing showed up. Our lawyer sent an email this week and they said that they received the info but have not reviewed it yet. It's been 25 days since they received the docs. Now the date has updated on his case 2 times this week but still says admin processing. I've read some horror stories but I've also read that once the attorney or senator gets involved they get better answers. My 30th birthday is in 17 days and our religious wedding and party are in May a day before our 5 year anniversary.

Also. All of our friends from Guatemala that had to do this were notified after a month of submitting final docs of when their interview would be. We waited 60 days which is when the nvc says you have to allow and then our attorney called and the following month we received the notice of our interview. Honestly the worst system!

OMG! Agh!  I am so sorry.  I really hope he comes back to you soon.  I can only imagine what you two are going through.  Keeping you guys in my thoughts keep me posted and again I hope this nightmare is over for you. :(

i did it like you i was on USA and my wife ask for me i went couple months ago to el salvador , but i dont think you need to go because he is the only one allowed on the interview

Yeah i know i wont be able to go inside the interview with him but more for moral support.
