Afidavit of support

I was just barely going to qualify on my yearly income to bring my wife to the USA, but adding my stepson, her son will make it so that I will not have enough income. My daughter suggested someone she thought might agree to be a co sponsor. She was thinking that we would just need the co sponsor to cover the stepson. As the co sponsor my sister would need to cover both my wife and my stepson, her son, wouldn't she? I was thinking that the sponsorship would not be divided up; like I sponsor my wife, and my sister sponsors my stepson, but my sister would cover both my wife and her son; is that correct? The reason I am thinking that is where the required income is listed; it is listed with the number of people in the family, and with the stepson there would be three, myself, my wife, and her son, my step son. Thank you for helping me to understand this! She would also need to have the income to qualify, not combine with my income, and I think she does have enough income. If I understand correctly she would need to fill out the form I-864, sign it, send it to me, along with her latest IRS Return and her W-2's. Anything you could tell me that would help me understand how it needs to be done; I would appreciate that! Thank you!

Yes, as with you, should would need to be able to cover financially herself and her household as well as your wife and step son.

She would need to supply the I-864 form with all supporting documentation. Same as you are doing.

Again she also would need to be able to show 125% for a household of 4 then. Herself, her child, your wife, and step son.

It does not get 'divided' between dependents or incomes added together. It is kept separately.

Agree with the above comment. Your joint sponsor must meet the requirements independently, not divided with you. The household number to count is sponsor+sponsor's dependents+all intended immigrants = Your sister+her son+your wife+your wife's son=4 people, so your sister needs to make $30,375 a year.

Note that the sponsors can exclude from the household size any child over 21 years old that they DON'T include in their Federal Tax return as dependent.

The sponsors also need to provide proof of being US citizen, like a copy of birth certificate or copy of biographic page of passport. If the sponsor is a permanent resident, they must provide a copy front and back of the green card.

Yes, my sister is alone, so it would be her, me, my wife, and her son, my step son that would need to be covered. So it would be four people.

Does your sister have you as a dependent on her Federal Tax returns? or are you a part of her household? Otherwise, she doesn't have to count you. Only her, her son and the two intended immigrants.

This is correct. Co-sponsor does not include the petitioner, just people on their taxes they claim as depends (i.e. her child), and the intended immigrants (OP's wife and step son). 4 people total then.

My sister has no son. It is just her. So she would include my wife, my wife's son, and herself, and that would be three. Is that correct? Thank you!

I can see how someone would think my sister has a son, because of my wording, my wife, her son, my stepson, but my sister has no son; she is alone. Thank you!

So, my sister, my wife, and her son are the people that my sister would need to cover, but I would not be included in that number because I am the Petitioner, and US Citizen, so it would be three people that my sister would need to cover to be a co sponsor for us. Thank You!
