My mother applied for my brother. She has a short of income.

Her w-2 says: $12478.47 Household->3 (my parents and my brother)

So I add myself, W-2: $13269.51(Current job)

                                1099-misc: $11625 (I did some  computer gig in the middle of year );

                             Total: $37372.98 (including 1099)     now  Household->4 ;i-864p->$30375

But should I add 1099 income to the current income? I am not doing that gig currently. I haven't done tax file for 2016 yet. If I can include 1099 income , should I add whole amount?

Regarding Tax return 2015:->

                                              Which line of tax file info should I add for tax return amount?

ok so mom will be the 864 form and like you said her household is 3 (unless shes sponsored before or there are other underage kids or dependents on her taxes). 

You will be on form 864a as a qualifying household member. Are you familiar with the form? Its pretty basic, not much different then the 864. You enter your "adjusted gross income" on it. Its on different lines of the tax returns depending if you filed the 1040 or the 1040ez or 1040a. It will say on the tax return 'adjusted gross income' line.  “Total income” is listed Line 22 on IRS Form 1040; line 15 on Form 1040A; or line 4 on Form 1040EZ (“adjusted gross income”)

Youre going to enter your income on the 864a for the last 3 years, so thats 15,14, and 13 because technically 15 is the most recent tax year. This will change to 16 after April 15th. (You and your mom may be required to submit an updated 864/864a if he is processed after the tax year flips) But for now its the years I stated. 

You then show current income. (#9 on the form) This is an odd situation because you are suppose to enter what you are expected to earn this calendar year. Since you are not doing the 1099 job, you cant really enter it.  Also your 1099 income isnt going to count for much. Since its self-employment income you need to show at least 1 year with it on your taxes for them to even consider it as future income- but since it was a one time job; well, its a dead end- there is no future. Proving you earned it in 2016 means little now. (If you had filed back in 16, you wouldve entered it as part of your current income for the year and it wouldve counted) But they dont count income youve earned in the past, its what you are currently earning. 

So what are figures like for the job you are currently employed at? If its the same as your last W2 (13269) then you would add that with your moms current income. So if shes also at the same job earning the same you guys are 12478+13269=25,747

For a household size of 3 the current guidelines are 25,200 (if I looked at it correctly lol) So it looks like you are just cutting it!

But honestly, Im tired and took some cold medicine, so Im not really on top of my game right now.... hopefully others will comment!!

no, you aren't adding yourself to the household, you are adding your income

 

your mom will file the i864, total 3, herself, your dad and your brother who is the beneficiary. since her income isn't enough, you would file the i864A as her household member, you don't add your parents to your form, you are only covering 2, yourself and your brother, so your household on the i864A will be 2

 

then your income will be added to the total, to combine both incomes on her i864

Oh yeah thats right. Since its an 864a and not a separate 864 (like a co-sponsor would be) you would have to add yourself to the household size... Then it looks like you guys just dont have enough even combined...

The reason why you cant use your 1099 income is because it is not part of your 'current income'. It is past income- (income from 2016) that you are no longer earning. If you were still doing the '1099 side job' then you could put it down as current income. Like I said they are looking at what you currently earn this calendar year. They do look at what youve earned in the past but only as an indication of your earning capacity. If you were filing the form in 2016 then it wouldve been your current income. (If you did file a few weeks ago and then they asked for an updated form in 2017- youd be in the same situation you are now. Currently you do not earn anything except from the W2 job)

 

There are a few webpages called things like pitfalls on the 864 or common mistakes made- they all consistently and clearly state its this calendars years income that they are looking for and what needs to be disclosed on the 864. 

 

There is another member that I know is very good with the 864- honestly its been a long time since Ive delved into this. Im going to message them and see if they can respond.
