They always give such mixed info. I know what you mean about wanting to check for a RFE. I hope you guys will be able to check soon.

As far as I know no.

We got an RFE for my I-129F visa application and we found it out our because my fiance(now my husband) wanted to see if there was a status update.

So, it's my understanding that the whole AOS process is put on hold for now and restarts once we send in our RFE paperwork. I am assuming it is because I only sent my W2s for the 2016 year and not my tax returns. I'm currently working on my tax returns with my accountant, but I've hit a road block because my husband and I were married on December 30, 2016. Technically I have to file as married now, but I don't know how to file! Jointly or separately? He never worked, but would have to get an ITIN in order for us to file jointly and I'm unsure if he can still file as exempt on his F1 if we file separately, now that we are married. 

 

Does anyone have any insight on how they filed their 2016 returns having gotten married?

I'm also assuming they will be asking for my tax returns, but it could be something else!

 

I'm just a little worried because we have a family event in his home country in July.

Hi, we got married on Dec. 31, 2016, we filed married filing jointly for 2016 Tax return. Though my wife is not working yet, but she was able to get a SSN prior to filing the tax return.

 

We used a tax preparer, I didn't want to do it by myself and screw things up.

What a good news to start our morning! USCIS has cashed out our check a while ago, around 7 am PST. So definitely, we will be hearing from them before this week ends. 

 

Sent AOS and EAD packet: February 24, 2017 (Friday)

Chicago lockbox receiving date: February 25, 2017 (Saturday)

USCIS check posting: March 16, 2017 (Thursday)

May 21, 2021 - received a call and email from USCIS Los Angeles with my NOA with my oath schedule.

May 28, 2021 - oath taking schedule in USCIS DTLA office. 😍

SO I just got my interview date!!?????! Is this weird that my EAD and AP still say case was received, and on my timeline it shows that I would receive the EAD and AP after my interview date, so does this mean I wont receive them at all and just the green card first? Things seem to be moving a lot faster than I had expected.. I am bit surprised I have an interview though as I came here on a K1 WITH my fiancé after living together overseas and being together for so long.. oh well I am happy! But a  bit confused :/ Hope everyone's case moves fast too!

Wow! How lucky! That's a very short processing time, giving all of us hope that the Green Card journey might not be tgat long after all.

It looks like since your interview is so soon they might just process your Green Card first, which would mean you will not need your EAD/AP. That's just a guess though, never know what to expect with USCIS ;)

Let's hope we'll be in the same boat.

That would be great for all of us who filed for AOS. But yes, you never know what to expect from USCIS.

All we can do is to wait and see...let's keep our fingers crossed.

Oh wow, that's great for you! I'm really surprised as Los Angeles belongs to the offices like San Diego (the one I will have to go to) that has AOS waiting times over 200 days. You're pretty lucky, I don't know what happened to your file that it sneaked in front of all the others that have been waiting for longer to get an approval in LA ;) 

Oh and around 50% of all K1s actually get an interview, so don't worry about that. 

 

Edit: Never mind, I just saw that LA has only 130 days processing time on average... I thought it was similar to San Diego... oh well, can't I just move my AOS file to Los Angeles then?!

Pretty much all documents you ever submitted. You always sent the copy so they might want to see the original. Evidence that your marriage is legit (pictures together, evidence of co-mingling of finances, lease together etc.). 

 

The chances are slim that you will  get as lucky as this guy though and have the interview any time soon. The average wait for the interview is 200 days. So plenty of time to look up what you will need at the interview. Just look at the guides to find see what you will need to bring. I think they also write that in your interview letter though what they want to see.
