O1B Visa Application RFE

Hello,

I applied for an O1 through premium processing and received an RFE. This was on the 24th and it is currently the 31st and my lawyer has still not received the RFE from USCIS.

Does anyone have any experience with how long it takes for it to arrive? So far over a week is a long time to wait for a document to get from Vermont to North Carolina.

Just for everyones information my RFE arrived!

It is a very short RFE and to be honest, is bizarre.

1) They refer to things in my cover letter, that they seem to believe are in my Critical Role Category (they are quite clearly not).
2) They mention three authors of letters for Significant Recognition Category - one of those authors did NOT write a letter and the third is someone whose name I have never heard of in my entire life and does not appear anywhere in my case.
3) A plethora of mistakes and information that is completely divorced from my case.

I have a physical copy of the visa application, it is very professionally put together and very easy to read. How is this level of incompetence normal?

So it seems like the RFE is mixed up with another case?

In one section on my RFE they are referencing information by person that I do not remotely recognize or is in anyway involved in my visa application - yes. They also appear to have not even read my Critical Role section as the Critical Role section of the RFE refers to items mentioned in my introduction cover letter, NOT the actual critical role section of my original application.

Mmhh ok, well I would not exclude the possibility that a USCIS might do a mistake be the masses of applications that go through the hands every week. Your lawyer should be able to clear this hopefully. Will you loose a job because of the delay?

I won't loose the job because of the delay, I am concerned I will loose the job because USCIS are not even reading my case. My lawyer is understandably furious at the response.

We also discovered the mysterious name is from a famous artist who has been dead since 1937. We are both bemused and baffled by this.

Wow that is for sure a story. I would assume that with that pointed out by your lawyer in the response to the RFE this will call quite some attention and probably move up to a supervisor level at USCIS as the first adjudicator wasn't doing his job by any means. Unfortunately you loose time and have to hang in there which can be grueling.

I would think things will work out for you if otherwise your application was solid.

How many month do you spend for the O1 application?  Do you choose regular time?
