Hi, my husband and I got married in July 2013, I entered the US as a CR-1 holder in July 2014, and we filed our I-751 on May 2016. In December 2016, we got a RFE to establish that our marriage was in good faith. Here is what we submitted in May:

- Joint tax returns.

- Affidavits from my father in law and brother in law.

- Pictures from our wedding reception in the U.S. and Chile, from our honeymoon, and from a wedding we attended together.

 

Here is what they ask for::

 

1. Copies of driver’s licenses from the state’s department of motor vehicles

  • We are including a copy of my husband's driver's license but it has his parents' address on it. I do not have a driver's license, but we are including a copy of my driver's permit on it.
  •  

2. Legible copies of any children born to you and the petitioning spouse:

  • We are putting off having children as I am in school and I'd like to develop my career before becoming a mother.

 

3. Copies of bank statements that reflect joint savings or checking accounts.

  • We keep separate accounts using the same credit union. We are enclosing statements of those accounts.
  • We use the mobile app venmo to transfer money back and forth and have included a statement showing our transaction history. It lists 45 transactions in 15 months.
  •  

4. Copies of mortgage agreements, deeds or other instruments demonstrating joint ownership of property or assets.  

  • We are renting at this point and, therefore, do not have assets together.
     

5. Copies of insurance policies such as life insurance, vehicle insurance, etc

  • We have health insurance through my husband's employer and are providing evidence that we have been insured together since 2015.
  • We also provide a copy of our car insurance (I'm listed there because I am driving with a permit)
 
6. Copies of credit card statements
  • We do not have any credit cards together.
  •  

7. Copies of loan documents, such as car loans, home improvement loans, business loans, etc.

  • We have two cars, but both of them are in my husband's name.
  •  

8. Copies of State and Federal Tax returns

  • We have filed together since 2013 and are providing evidence of this.
  •  

9. Copy of rental leases/agreements

  • We have rented the same place since 2014 and are providing the leases as well as certificates of rent paid issued by our landlords.

 

10. Copies of utility bills such as telephone, gas, electric, water, cable internet, etc or other statements issued in both names indicating residential address.

  • We only pay for electricity and our phones, but those bills are under my husband's name.

 

In addition, we provide the following evidence:

11. Affidavits:

  • Affidavit from our landlords, who come to our rental property on weekly basis.
  • Affidavit from our housemate (we sublet a room in our house to keep our expenses low). She has lived with us since October 2015.
  •  

12. Evidence of trips together:

  • Flights to Chile after our wedding.
  • Flight for our delayed honeymoon in April 2014.
  • Flight to Seattle in April 2015.
  • Flight to Los Angeles in March 2016.
  • Flight to Chile in December 2016
  •  

13. Pictures:

  • Wedding reception in the USA, including both our parents in July 2013.
  • Wedding reception in Chile, including both our parents in December 2013.
  • Wedding picture from my brother in law's wedding in April 2015.
  • Family vacation in Minnesota including both our parents in August 2016.
  • We have many more pictures, but I am not sure if they are strong evidence and I'd be wasting my time including them.

 

Do you think that what we have is enough? What suggestions do we have? I know it would have looked better if we had combined finances, but we haven't done this and it is too late to fix that now. Thank you very much for your help!

It's very simple will look better with the same address since your evidence are not the strongest in here everything helps.

Hi Georgia16, thank you very much for your reply! He has not done so because we are afraid of mail getting lost in our current address. We get all our mail at his parents' house, which is 10 minutes from where we live and we go there about once a week. Additionally, we are planning on moving back to his parents' house in 60 days.
