Hello,

 

I live in Germany. My fiance is from new Jersey. We started to fill out the K1 Visa form and send it to uscis in Dallas/Texas.

My fiance called them and wanted to check the status and they didnt tell anything, but they give him a receipt number. I thought also he would get informed via email that they receveide the forms and would gave the receipt number. We found that all out after we called them.

So we checked online and it said that it was rejected, because one of the forms wasnt sign. Also that they will send the papers back so we can sign the papers and send them back again.

There was an Information as well if my fiance dont receive anything until January 11 he should call them. So he called them and they said he has to wait 2 week and call again. After this two weeks he called again and they said they made an request and he should mail. It is really strange for me because we waiting since December just to get the papers back from them. During this time Homeland security came to his house and asked a few question about our relationship. This is all strange. Is that the normal process? So my fiance is thinking to apply for a new K1 visa instead of waiting until the papers Comes back. Should he do this? Did we apply to the wrong uscis? We just download all the papers online and filled out and mailed it to uscis in Dallas. I would be happy if I would get any Information. Many thanks

Your fiancé should get on visa journey and read up on K-1 visa process- what to send, additional form to include for tracking g-1145 and how the forms are completed- there's a gallery with samples of completed forms.

The OP stated she is from Germany in her first sentence, as well as her profile lists her country.

 

OP, it is not normal for USCIS to do a field visit to the petitioners home, especially that early on.  Leads me to believe something may be going on with him you may be unaware of. How long have you known him? Is he USA born citizen?  You really should not apply again just yet.  You really need to find out what is going on with your first petition and why Homeland Security felt it necesssary to come to his home.  If all that is needed is proper signatures then you can sign the forms and resend the packet.

I was just wondering, if the issue is just about some forms your fiance have failed to sign, it does not really merit a denial right off the bat. It should just be under RFE (Request for Evidence) and once you are able to provide what they want you should be able to continue with the normal process for K1. LionessDeon may be right. I think you should take time to look into things in your relationship and try to know your fiance more. It seems strange that he gets a visit from Homeland Security and gets asked about your relationship, I haven't heard of any K1 visa filers going  through that. They may have found out something suspicious about your relationship for them to visit him. Not saying you are not legit but they might know something and that something pushed them to pay a visit to your fiance.

Many thanks for the answers. I known him over 2 years. He is a born us citizien. I told him that as well that this is not the normal process. Everything so is so strange. I was before several times in USA. I never had any Problems. Since he applied for the Visa my esta denied. I said to him that something is wrong  because they would not do that like this especially when the visa didnt even process. We send all the papers. and we didnt get any Information, we find that once we called them. Now he got a letter which the say that they send it but that is not true. We did not get anything. Everytime when he is calling he do not get any Information. It wasnt denied it was just rejected because he did not sign, so he has to resubmit. For that we Need the papers back, but he never get the forms back.

Okay the I-129F is not a visa, it is a petition.  If the petition is approved then you can apply for a visa.

 

Now there are certain reasons that a petition can be rejected (no check cashed) and denied. You wont get a receipt number if the petition was rejected.  Has your fiancé petitioned anyone else before? Did you meet online?  Does he have a criminal record? Did you sign your G-325a and letter of intent? Did he?  Was the check or money order cashed? 

I suggest your fiancé sign up for VJ if he needs help with the I-129F petition.

I met him online. It was money order. I did sign the G-325a (but electronically through pdf ) and we didnt put the letter of intend because we thought we have to send this later.  I guess he has a criminal record for a small thing, which happened 18 years ago. As i know he married 14 years ago in USA and applied for the Greencard. She was there with a visa and they married and he applied for a greendcard for her. But he never did K1. This is the latest information

He want to print all the papers and fill it out again and send it again because he never received the papers

Yes of course, he visited me, i visited him, we travelled together and  i was also for 6 months there as Student Exchange so we saw us often.

The last time he visited me was 1 month ago

Letter of intent is required with the I-129F.  All signatures must be wet signatures (pen on paper.) His criminal record is also important for the I-129F and you two must prove that meeting online wasnt a marriage broker website.  You missed two of these 4 already.  Im surprised you cut off the bottom of the message saying WHY it was rejected.

 If it is required, why they didnt mention this as well. They mentioned only the signatures. My fiance wants to print all the papers and pay the 340 again and resubmit. Should he do that because he did not get the papers

He gave all the Information what needed beside the letter of intent and the signatures. Here is the bottom, but that does not help me

Please use our guides here on VJ and talk to your fiancé about this too. Also on the USCIS website there is a checklist for the I-129F which states original letters of intent.  Also the fee is now $535 not $340.

A rejected form normally would not have had the money order cashed. 

He should wait to get the petition back before resumbitting.
