Did she ask you for a specific document ? Whats next, will you be called for another interview or do you need to just wait out ?

That sucks... 

 

Thanks for the insight. Hope the IO doesn't keep you waiting long. I wonder if the marriage evidence was the only issue. If you don't mind me asking, do you take long frequent trips to Europe? This trip you're on could mess with your recommended for citizenship. You still need to fill out one last form before taking the oath. They ask about trips on that form so play it safe.

Just curious, on the selective service part. What did you print and where?

Lil background: I came state side on a non-immigrant visa, so I didn't register. Do I still have to print the form(?) to prove otherwise?

I filled it out this form here: https://www.sss.gov/Registration/Check-a-Registration/Verification-Form

 

I moved to Michigan when I was 15 and became a permanent resident when I was 19 I believe so I had to register.

As soon as she brought up my file, she said "you just got back yesterday." I said yes I have. I had planned this trip for a long time and didnt want to reschedule the interview, so I came back just for this. I don't make frequent trips to Europe at all. This is the second one in two years and they're usually around 10 days or so. It's never an issue to travel between the interview and the oath, you just need to notify them that's all.

I am applying under the 3 year rule. I gave her the new tax returns and she asked if I had any evidence we live together, and I told her I had some on my email, she said no. I asked if I should send her some of them, she said no. Just to wait to hear from them in the mail. And she goes "We have a 120 days to notify you".

Oh boy why didn't you take any evidence with you about your marriage ? Just taking current tax return is not enough. There are so many things you could have taken with you.

They didn't ask you to come back with more evidence?

Question of the day as I prep for my interview next week.  If I have been here for 12 years, came on a K3 (marriage visa), do I still need to prove my current marriage (Which I have no problem doing)?    Since I passed the 5 year mark, am I even applying through the marriage eligability.    The only reason I ask, is I just want to know how much work to do to prove we are still married and bring evidence for.

From what i know, since you have passed 5 years as a legal permanent resident (green card) you qualify under the 5 year rule of Naturalization and you dont need to prove your current marriage although questions may be asked about your current or old marriages (if any) at the interview time.

 

You have to prove current marriage ONLY if you are applying under the 3 year rule of Naturalization based on marriage to a US citizen.

"According to law, a man must register with Selective Service within 30 days of his 18th birthday. Selective Service can accept a late registration but not after a man has reached his 26th birthday." https://www.sss.gov/Home/Men-26-and-OLDER

 

You may or may not have been exempt from registration. You were exempt if:

  1. you came to the U.S at 26 or older 
  2. you came to the U.S before 26 but maintained your non-immigrant status until after you turned 26.

You were required to register if you fell out of non-immigrant status before turning 26 (doesn't matter if you were illegal). You were also required to include this information in the N-400 package. If you did not include this information you need to have a letter from the selective service explaining why you did not register. If you were required to register and you didn't, you're application will be denied and you may face a lifetime bar from becoming a citizen (hope that's not the case).

 

Side Note: I came here as a non-immigrant at 18. I eventually registered before turning 26.

Ouch, sorry to hear bud. The process is long to begin with.

I hate to say this but the waiting is killing us. SF Field Office is the slowest and most unstable in processing cases. 

We have been waiting for almost 120 days after being put in line for interview. I was hoping I used my other address which is under SanJose Field Office.

N-400 Naturalization Journey SAN FRANCISCO FIELD OFFICE

Total processing time from last successful submission to Oath Ceremony: 253 days (8 months and 11 days)

Spoiler

02/26/2012: Arrived SF airport. 

11/28/2016: Eligible for early-filling.

Day 00 - 12/23/2016: Sent N-400 + I-942 to Phoenix, AZ lockbox via USPS.

Day 03 - 12/26/2016: N-400 application marked delivered.

Day 25 - 01/17/2017: Sent email to support regards to application.

Day 26 - 01/18/2017: N-400 rejected because incorrect payment amount.

Day 32 - 01/24/2017: N-400 + I-942 resent.

Day 34 - 01/26/2017: N-400 application marked delivered.

Day 49 - 02/10/2017: N-400 rejected again because incorrect payment amount.

Day 52 - 02/13/2017: Email form USCIS support responded package was rejected in error (!?) for the first and second time submissions, they requested 3rd resubmission + tracking number in order to apply my earliest priority date. 

Day 52 - 02/13/2017: N-400 + I-942 resent on the same day, also sent a response to Lockbox to provide information to USCIS.

Day 54 (Day 0) - 02/15/2017: N-400 application marked delivered.

Day 62 (Day 8) - 02/23/2017: E-notification, E-mail from USCIS, E-mail from Support announced Resubmission was accepted.

Day 66 (Day 12)- 02/27/2017: Notice of Acceptance as Fees Waiver Approval received. (All fees were waived instead of reduced by half as supposed by filing form I-942)

Day 69 (Day 15) - 03/02/2017: Online Status Update: Fingerprint Appointment was scheduled. 

Day 70  (Day 16) - 03/03/2017: Fingerprint Appointment Letter received. Biometric will be on 3/15/17. 

Day 70  (Day 16) - 03/03/2017: Early Walked-In for Biometric at 3:45 PM.

Day 87 (Day 33) - 03/20/2017: Online Status Update: Case was placed in line for interview. 

Day 234 (Day 180) - 08/14/2017: Online Status Update: Interview has been scheduled.

Day 239 (Day 185) - 08/19/2017: Interview Letter received.

Day 269 (Day 215) - 09/18/2017: Interview 2:30 PM at USCIS SF Field Office. Recommended For Approval. 

Day 280 (Day 226) - 09/29/2017: Oath Ceremony Letter received. N400 is approved.

Day 291 (Day 237) - 10/10/2017: Last Online Status Update: Oath Letter was mailed. Too late!

Day 307 (Day 253) - 10/26/2017: Oath Ceremony in Oakland, CA. Citizenship granted.

Day 307 (Day 253) - 10/26/2017: Passport applied.

Day 321 (Day 267) - 11/09/2017: Passport Booklet received.

Found this on a website  (www.lawqa.com ) where people can ask legal questions. Someone asked:
 
"I did not register for selective service,can I still apply for citizenship? I am now 35 years old" 
And these were some of the answers from two lawyers :

 

 
"You should be able to apply for naturalization with no problem. Normally, not registering for selective service between the age of 18 to 26 is considered bad moral character and would prevent a person from qualifying for naturalization. Because you are over the age of 31 (five years after your 26 birthday) you are passed the 5 year look back period and you can apply for citizenship without the non-registration causing a finding of bad moral character."
 
AND THIS:
 
"You are required to apply for selective service between the ages of 18 and 26 are required to register for selective service. Failure to register for selective service is considered by USCIS to be a bar to good moral character if an individual knowingly fails to register. However, the requirement for good moral character is five years prior to the application. Since you are now 35 years old, it has been 9 years since you were required to register and your failure to do so is outside the 5 year period during which you must establish good moral character. For that reason, it will not be a bar to naturalization for you and you can apply for citizenship if you meet the other requirements."
