I have viewed this page alot and finally signed up!:D

I have been in the US a month now on a K-1 visa, me and my missus Elizabeth got married on the 16th! I am getting ready to send off the readjusting status paperwork, I have the application all filled in ready to go.

Now as of the 23rd of December 2016 the I-765 and I-131 are about $1000 between each other. So my question is do I really need to shell out for them as I don't plan to go back to the UK for a couple of years and the work permit runs out once my k-1 status expires?

I look forward to hearing your responses!:D

You should be posting this at the adjustment of status forum to get better answers. You're way past k1.

if you read the guides, you'd know that filing for i765 and i131 with the aos packet or with a pending aos will waive both fees (i765 and i131). So if it's free why not file?

As others said, when you apply for the working/travel permit along with the AOS, you don't have to pay extra. Also, you never know what could happen, there's so many things that could make you wanna go to your home country without planning.

More importantly, your EAD/AP card doesn't run out once your k-1 status expires. Once you receive them, they are valid for as long as your AOS petition is being processed and pending results. So if for some unlucky reason, your AOS processing took a year or more, you wouldn't be able to work or leave the country for any reason at all without the EAD/AP card.

Also, in my personal experience, until I got my driving license, the EAD was very useful to me to prove my legal status everywhere I needed to (So if you get your driver's license right away this particular reason might not apply to you). Not everyone knows what to do with a foreigner who entered on a weird K-1 visa that expires upon entry, has a I-94 that expired after 90 days and only has a piece of paper that says that "Adjustment of Status is being processed" to convince people that you are here legally.
