Fiancé visa London interview question about co-sponsor and I-134!! Help!!!!!!!!

Hi everyone. I have a question about the I-134 for my fiancé. At the London embassy, do any of you have experience with joint/co-sponsoring your fiancé? My father makes a nice salary and has agreed to co-sponsor my fiancé because I have been a full-time student and just graduated and am trying to find a job. Thank you!!

London has no problem with co-sponsors. They will require an I-134 from ONLY the co-sponsor, as well as their financial evidence. That evidence can be something like their most recent tax transcript and an employer letter. Also expect that during the interview, your fiancé may be asked questions relating to the co-sponsor. Remember though that sponsorship is a two-fold process. Once your fiancé is in the US and you marry, you must file AOS, and this will require the more stringent and legally binding financial stuff.

THANK YOU! <3 I will have a job within 4 weeks but the interview will be before then. And hopefully he be able to find a job within the 90 days before the wedding :) We are living with my parents for the first year of our marriage while we work and save money.

No problem. But can you clarify something for me? You said find a job within 90 days? Is this for the USC or the UKC? Keep the following in mind - the foreign citizen will not be authorized to work in the United States until - AOS is filed (with temporary work and travel document). The work document (EAD) can come up to at least 90 days after filing, and the green card may take up to a year. The UKC will not be able to hold a job in the US until they are authorized to do so. It took a long time for my husband to find work even with his skill, so be prepared for a long wait if necessary.

Well dang. I thought he could work asap by filing a I-765. The USCIS says "After admission, your fiancé(e) may immediately apply for permission to work by filing a Form I-765, Application for Employment Authorization with the USCIS Service Center having jurisdiction over your place of residence". Sorry, this is all so confusing for me. Also what is USC and UKC?

USC = US Citizen UKC = UK Citizen.

It will expire on the day the I94 does (end of 90 day period), and due to the wait times of up to 90 days, it's unlikely you'd even have the document in hand before it already expired. Making it kind of a pointless waste of time and money really. The best way is to file for AOS as soon as possible, which will protect their status in the US, and file for that along with the EAD/AP (EAD/AP fees are waived with paying the lump sum for AOS). You can try to apply for an emergency or expedited EAD/AP during that process I believe. I'm sure someone here could advise you better on that process.

It's important that you get your head around terminology as there will be plenty of it going forward.

 

There is no such thing as a co or joint sponsor for an I-134. There is only one sponsor. For the UK, that sponsor does not need to be the US fiance(e) - it can be any US citizen or lawful permanent resident.

 

With I-864 there can be joint sponsors. This isn't interchangeable with "co-sponsor". The primary sponsor NEEDS to be the spouse. The joint sponsors can be any US citizen or lawful permanent resident.

Second to this, I was in the same position. My other half was a recent graduate and didn't have much in the way of income proof. Her father sponsored the I-134 and I took that and the most recent tax transcript to the interview and everything went well.

 

The only question related to this that I had to answer was who the person was.

 Thanks for all your help! I am not very familiar with the terms used because I have never used this website or anything. From the time I sent my petition to the time I got my NOA2 it was only about four weeks. I have done a pretty good job of everything so far.  I'm about to send my fiancé a copy of our approved petition (I know the consulate will probably have it but I'd rather be too prepared than not). Also sending him my fathers I-134 with some bank statements, W-2's, and tax returns. He's got an appointment to get his list of vaccines-for some reason his local surgery made him wait a couple weeks so they could locate it? And then off to his medical he goes! And then hopefully within a couple of weeks after that we can schedule his interview at the embassy :) we took a 6 week break from the time I got NOA2 till we started making any head way towards the interview. He got his letter from the embassy mid December

As he got his letter from the embassy, he should have had a copy of the approved I-129F with that.

 

It will probably be easier for your father to request his tax transcript from the IRS. This is free and can be done online. That way all you need is the latest IRS tax transcript (no need for W-2/return) and completed (signed too!) I-134.

 

As it sounds like he meets the financial requirement via income he won't need the bank statements.

 

Remember that as soon as he has the medical, he has 6 months to enter the USA.

Yes he did get an approved I-129F! And thank you, that's great to know about my dads taxes. Fiancé plans to come in June or July. We've got our wedding scheduled for Aug 25. And the venue will let us reschedule for another date if for some reason something goes wrong with the process.

Thanks for this thread, about to send our initial petition to USCIS and start the process but have been worried about the income and I134 form when we get to interview. My fiance doesn't make that much but her mum is a pharmacist and wants to co-sponsor so that is a relief.  How come your petition went through so fast? did you do a full binder with loads of evidence etc in it? we have done that and have a lot of stuff to make it easy for them to go through. just curious how you did yours and how it got looked at so fast. may have been some luck but curious all the same. Excited for you guys!

The mail room contractors will have to spend time taking your binder apart and throwing it away and organizing in a standard folder. The USCIS officer who gets your folder will never see binders, sheet protectors and such. Speedy approvals are not because of creativity points on your submitted package. Sometimes a new file gets pulled for training purposes and gets ahead that way. Just luck really.

Do not submit a binder!!! Submit everything exactly how USCIS recommends it. Order some ACCO fasteners off amazon and follow these directions https://www.uscis.gov/forms-filing-tips 

 

I genuinely think using the ACCO fasteners helped and using tabs for easy navigation helped. Do what they ask and hopefully it’ll be “quick” for you guys.
