Yeah, it is 6-8 weeks from NOS. But there is a lot of variability so you might get lucky.

Mine took 7 weeks.. I was hoping it would be faster too.. but that didn't happen..

I don't know. It seemed to me like there is a queue or maybe there are several queues according to the type of waiver people are doing. But I have entered random numbers and people with similar application dates and NOS dates go their final waiver at very different times.

Are you in the US and trying to do AOS before the J1 and/or DS expires??  I read somewhere in the forum that if you overstay your B1 and file for AOS the overstay is forgiven .. I'm not sure if that is the case with J1s..  don't quote me on this, but is worth looking into it if you are in that situation...

I filed for AOS before receiving the waiver and before my J-1 expired and we have out interview date in one month! As long as you file before your grace period ends you should be fine.

Hello! Question! Should I already apply for AOS even without the actual waiver for my 2 year

home residency? I am

on J-1 Visa and will expire in June 2018 but my husabnd and I chose for me not to work this school year because I read in some forum that once you applied for waiver for 2 year home residency and got favorable recommendation from DOS, you cannot work anymore under your current J-1.

 

I got the letter from dept of state which favors my waiver and they sent a copy to me and one to USCIS. 

 

Now, what I currently receive is just I797C or notice of action from USCIS that states that they got the waiver recommendation and payment from DOS.Right now, I don't have the actual waiver from USCIS yet and I am confused if I should wait for the actual waiver from them before filing for AOS or file now while waiting?

 

Also, is it true that J-1 visa holders can no longer work if application for waiver is now with USCIS?

Like I've said before, I applied for AOS before receiving the approved waiver and my process seems to be going fine. I will bring the approved waiver to my interview. I did send copies of receipts and included a small explanation.

 

I was told by the lawyers at my school that filing for AOS did not affect my J-1 and I was able to finish my program without problems. We consulted with my Responsible Officer before doing anything because of your same concern. I do know that once you receive a favorable recommendation you are not eligible for a DS-2019 extension.

One detail I should mention is that I filed for AOS towards the end of my program so that was still pending when my J-1 was up. I'm not sure how it works if you get a green card while still having a valid J-1, I assume it will make the visa void (but that is just a guess). What kind of program are you in? I know you want to get the AOS over with but it might be ok to wait a bit so you can finish whatever it is you're doing. Consulting with your RO is also a good idea since they will have access to more legal resources.

 

I was working at the university until my J-1 expired so I don't see why you shouldn't be able to do this too. AOS is a long process where you are not allowed to work so if you can time it right with the last few months of J-1 I recommend you do that.

Why do you have the 2 year home residency requirement? 

 

I think it is better to AT LEAST start the J1 waiver application because some embassies take for ever to send the No Objection Statement (NOS), so you don't want to get to your interview stage without the waiver.

Yes, your J1 expires once you get the waiver, but it can take a while to get the waiver. Mine took a bit over 5 months, for instance.

Oh, Ok. Maybe you should have started here. So you got the DOS favorable recommendation and are waiting on the final decision from USCIS. I'd wait until the final decision because mine arrived very fast, like a week after the notice of action. In the meantime, have your AOS package ready to go.

As I said, your J1 expired when you are waived the 2 year home residency requirement. 

 

With AOS you have to apply for an EAD which takes ~4 months. Once you get that you can start working again.

Yes I got favorable recommendation from DOS but no final

letter yet from uscis. USCIS just sent me

I797C which is a notice of action that they received a waiver recommendation from

DOS. I have not submitted for I-612 (application to waive foreign residency requirements) yet though. Do I need to file this separately or concurrent with AOS

 

I wonder if I need to file this now. I only submitted my DS3035 and some other paperwork to DOS and this gave me faborable recommendation. I don't know about whether or not to file I-612 now.

 

i am sorry if this doesn't belong to this thread. I am new here, still figuring out visa journey, and i am

only using my phone.

 

btw. I am under the 2 year home residency because i am under the skills list. Once again i was granted NOS by my country and favorable recommendation from DOs already.

You don't need to file anything else. I-612 is the form assigned to you at the USCIS stage. You just need to wait for them to approve the waiver and send you the approval notice.

I am a little bit confused. Isn't I-612 a separate form? I did not file this kind of form before, only DS3035 to  DOS.
