It was a receipt notice and only confirms that USCIS has received the application/petition listed above (I-612).

 

I used the receipt number to check the status (since the correspondence was mailed on the 16th) and it says that the case was accepted.

Second, Congrats!! It appears that you are not required to fullfill the 2 years, therefore do not require a waiver.

This doesnt affect your AOS, though including the letter you will receive from the DOS saying you are not subject in the application would be a good idea.

If you want to be extra sure you can consult with a lawyer after you receive the letter.

That is why i am confused. I applied for the waiver. i followed all the instructions,  i sent both Ds3035 and 2019 the fees the statement and my embassy sent the No objection. Now they said i am not subject?. 

so During the interview stage of the AOS, i can just tell the interviewer DOS said i am not subjected with the letter?

That means they received you case.. once it is approved it will say approved on the letter and maybe in the website (it doesnt always update)

Consular officers make mistakes all the time because there are many things to be considered to know if you are subject or not (where funding is coming from, your country, skills lists, etc). The letter you will receive from DOS is your proof.

it is just a lil bit confusing cos the 212e rule was on 2 different visas at two different times

Btw, thank you for your input. duly appreciated 

 

They cannot issue a waiver because it turned out, you were never subject. You will still get a formal letter by DOS in the mail so you can take that to your interview. You can also print the page from the website and turn in your confirmation number and the consulate should be able to check the information.

 

If you don't get the official letter, but if you wait a couple of weeks and never get, or if you need it asap, send an email to the waiver e-mail and ask for an official letter by e-mail.

Hey Guys!! after a long wait I finally received my approval notice!!:dance:  I just wanted to share my timeline with you all..

also I must note that I had so many issues with receiving my letters/notices from USCIS due to the fact that when I filled my application with the DOS I wrote my Dominican Address as my current address (and mail here sucks) thinking that mail would be sent to the address I wrote  on the mailing address field.. It turns out USCIS sends mail only the the address stated as current...  I hope info this helps someone else not to make this mistake;).  I still dont know why they couldn't find me in the system whenever I called even after I was approved...

 

J1 Waiver Journey

April 07 2017:   Requested NOS from government agency

April 09 2017: Mailed form DS-3035 to DOS

April 20 2017: DOS received documents

June 15 2017: DOS received NOS from embassy

July 04 2017: Sent email to DOS requesting to expedite case

July 11 2017: DOS replied case is with a waiver officer for processing

August 1st 2017: Favorable Recommendation Sent

August 12 2017: Received letter from DOS

August 14 2017: Called USCIS to get receipt  number - They don't have a case yet...

September 1st 2017: Called USCIS to get receipt number - No case Yet - officer placed a service request to the VSC asking for info.

September 15 2017: Called USCIS again asking about my inquiry - Still no case in the system - Tier 2 placed another service request because he noticed the first one had my name wrong...

September 29 2017: Called USCIS again asking about my inquiry - Still no case in the system (Tier 2 was a Jerk) - 1.5 hours later I received an email with my receipt number (USCIS received on August 7 2017)

October 2 2017: Went into an InfoPass appointment and was informed that my waiver has been APPROVED on AUGUST 21 2017 I couldn't update my address to receive hardcopy though...

October 4 2017: Updated address and requested a copy of the approval notice using the online tools.

October 11 2017: received email notification that case was approved on October 6 2017 (WTH?) app also updated to approved.

October 20 2017: Requested approval notice again.. using online tools

October 28 2017: (FINALLY!) Received Approval Notice in mail

Hey!

 

I wanted to ask, when you found out that your waiver was approved, did the website show it as approved?

 

I ask because I want to call or go to the infopass appointment to get a response as soon as possible.

The website didnt change.. later  on oct 11 it changed to approved on october 6.. but I had been approved august 21 already.. so IDK why that showed up..

oh ok! Someone cancelled their infopass appointment and I just got in last minute. If you dont mind me asking:

 

1. What documents did you bring to your appointment?

2. When they told you that it was approved on Aug.21, did they give you a copy of the approval letter?

3. What was your overall impression of the appointment?

4. Do they let you in the building/office with a backpack?

5. If my case is still processing, would you recommend asking them to speed things up? 

6. Any recommendations/suggestions?

your passport and any other document related to your case (I brought my letter from the DOS and an answer to an inquiry I had placed where they said they couldnt find my case)

the officer I got said “there is no such thing as a copy of an approval letter.. that only gets sent once” but we all know that is BS, I hope you get a nicer officer, COco8 said some people have requested unofficial copies and received them at the infopass appointment.

very clean, very fast.. i think they cant tell you what to do or give you advice.. but if you come and ask the right questions they will def answer and help you. So show confidence

4. Do they let you in the building/office with a backpack?

yes, is like going through airport security

5. If my case is still processing, would you recommend asking them to speed things up? 

Again.. you have to ask the right questions.. asking to speed up will get you a big no cant do..  setting up a request to expedite will get their attengion.. I think once you get there you will find out you have been approved.. and if not you are entitled to ask the reason.. And request the officer to dig deeper

6. Any recommendations/suggestions? I already said some, but write down your questions and check them off at the appointment.. when the officer told me I was approved My mind blanked out.. and I left the meeting without bein able to ask the questions I wanted to ask..

Hi guys I really need help here..

 

so my notice has been returned to USCIS twice, they tried to deliver it to my office address both times. I don't know what happened. I don't live in US anymore since my visa expired. Should I ask them to deliver it to my apartment address where my roommate is still living or my attorney's office address because he needs my waiver approval notice? I already waited months for my waiver, my H1B application is pending because of it, this is just frustrating.. 

 

Also I scheduled an infopass interview this Friday, can I ask them to mail my notice to two addresses at once? Is there anything I should ask them during the interview?

 

Thanks for any help!!!

Yes, you might want to ask to be delivered to your attorney's office. 

 

USPS usually does not leave letters if the person's name is not on the mailbox. They might be delivering the letter because of that.
