Waiver Approved August 21 2017... didn't receive any kind of notices because they were being sent to Dominican Republic... on October 4th I managed to update my address and request them to send another approval notice...  It is October 18 and still haven't received the letter on the mail..  I need to have this letter by November 15 as I need to bring it to the embassy for my visa interview..

And just so you know my K1 visa was approved October 10th and I received the approval letter October 13.. So I do get mail from USCIS.. just not THIS ONE!!! :unsure:

 

Can you have someone in the US (better your fiance) make an infopass appointment and ask for a copy of the letter on your behalf? I know some people got a copy like that. You can send him a scan version of your passport and the number they gave you.

Also I went to the congresswoman's office last Friday and they sent an email to USCIS on my behalf, they told me they expect to hear back from USCIS within a month so we will see!

Sometimes USCIS never gets the DOS letter or they do not process it by mistake.

Other times, they approve the waiver and the letter gets lost in the mail.

You can wait for whatever your congressman gets for you. If you are in the US you can also make an infopass appointment with USCIS and go talk to them.

Hi thanks for reply! I am actually leaving the US tomorrow.. I don't think I will have time to go to the appointment.

 

However I never received any receipts for my case from USCIS, how does infopass appointment help my case? The congresswoman's assistant said USCIS probably would give them an update on my case within a month. I have an attorney in US, can he go to the infopass appointment for me? I also have a friend who is an immigration officer but she works in citizenship..

Well, USCIS would be able to look up the case with your passport or other information. If it does not appear, then they probably missed the info from DOS and they have to start your case. 

 

I think if the congresswoman assistant is on it, you should be OK. I mentioned the infopass appointment in case you were in a hurry to get the waiver.

OK Thanks! It's strange since most people got their waiver 2-4 months after DoS sent recommendation letters. I have been waiting for 6 months.. They probably lost my documents or something. I will keep everyone updated here!

I went to an info pass appointment myself while I was visiting and the officer there told me that there is no such thing as a copy of an approval notice... that once it is sent once that's it..

and when I asked him what would I do then, because I need the hardcopy for the embassy he said that they will have to look it up in the system and verify the info when I am at the interview.. which sounds like BS to me.. specially since after that I went online and requested a copy to be sent again..

Did these people that you know received the hardcopy in there? or they just requested and got it by mail?

So if I remember correctly, someone got a "non official" copy during their appointment infopass.

 

I think the consulate can check through USCIS if the approval noticed was sent. You would have to give them the number by taking the NOA 1. You could even print the page on the website that says the approval notice was sent.

I wanted to add that the approval notice comes in a green type paper with the statue of liberty on the back. It is not a cheap paper they can print for you at any place. That is why the official paper is important. That said, the consulate should be able to check it online or make a request to USCIS so I would not worry if you are unable to take it. Just take the NOA1 and print what it says online,  and explain the problems you've had. They should be able to solve it.

I will call and ask and see what they say this time.. I dont even have NOA1 😐. The only proof I may have is the email they sent me when I requested a cooy of the approval that says you were approved on August 21 we will remail you the approval notice.. ofcourse I would bring this the print screen and whatever else I could think of as proof.. but it would be the worst to get denied because I dont have the oficial approval hard copy 😕

I doubt you will get denied. The worst that will happen is that they will tell you to go back when you have the official paper.

hey guys,

so i apply for Waiver of my 212e. My status changed to "not Subject". i am really confused as it was written on my passport and my DS2019 on two different J1 visas that i am "subjected to section 212E and 2 years rule does apply"

 

I don't know what to do as i plan filing for adjustment of status soon. What should i do?. or maybe a better question is what does "Not subject" means in relation to AOS and how does it impact the AOS application process?

Well first of all it appears as you didnt apply for the waiver, you applied for “Advisory Opinion” which is when you ask the DOS if you are subject to the 2 years or not.

Second, Congrats!! It appears that you are not required to fullfill the 2 years, therefore do not require a waiver.

This doesnt affect your AOS, though including the letter you will receive from the DOS saying you are not subject in the application would be a good idea.

If you want to be extra sure you can consult with a lawyer after you receive the letter.

Congrats! Like others said, it means you are not subject to the 212(e), meaning you don't have to go home for 2 years and you can file for AOS whenever you want.

Consular officers make mistakes all the time because there are many things to be considered to know if you are subject or not (where funding is coming from, your country, skills lists, etc). The letter you will receive from DOS is your proof.
