October 2016 Philippines K1 I-29F ISSUES/Approvals?

Hello ALL,

 

I am wondering if anyone is in a similar situation as me or has any news of approvals.

 

We sent our Application in October to Texas.

Received NOA 1 for October 28th 2016, transferred to California.

 

I have not received any update.

CSC made it seem like they where still on I29F applications received in August... but I know this isn't accurate.

The link she told me to view for processing times on the GOV website, says it was update Jan 15th... But the information says as of November 2016.

So I do not believe the CSC Agent I spoke to had accurate information. 01/22/17.

 

I contacted my congress rep here in Hawaii.

I received a reply in 2 days from her aid! I was sent a form to allow them to make a congressional Inquiry, I sent it Friday 1/27/17, and received immediate response saying they received it and would notify me right away of news.

So my Congress person Colleen Hanabusa and her Aid have been super fast to respond.

 

Has anyone else with a October 2016 Filing had any issues or have you received approval as of yet? It has been 3 months for me and I am wondering why its taking so long.

 

FYI

Fiancée is in the  Philippines and I am a born US Citizen. She is 26 I am 32... its easy to tell we are a "Real" couple. I have visited her 3 time in the last 6 months...

She is not Muslim.....

Welcome!

 

First, your case was not transferred to California. Texas doesn't process K-1s...it's just a lockbox for them. CSC is your service center. If you update your timeline with this info, you will see more accurate data.

 

There were hundreds of K-1 applications per day that came in during the last couple days of October and early November. Dec. and early jan. was very slow due to holidays and such. While most Oct. filers have been processed at this point, you're not alone. Hopefully you will hear back soon. The CSC agent is just going by the last official update on their website. It's way outdated. Check my signature for data showing tens of approvals per day for late Oct. & Nov. filers (and occasionally a Dec. filer or two!).

 

That's good that that your congresswoman was able to respond quickly! That said, I wouldn't expect anything it come from it as you are well within the normal processing times still. Until you are 5-6 months or more waiting, you're in "normal processing times" so there's little to nothing that they can actually do.

 

Being a real couple or not actually doesn't matter at this point. The I-129F is just to verify that you meet the requirements (i.e. met within the last 2 years, are a USC, etc.). Religion *shouldn't* have an impact on this process.

 

In summary, you will probably hear back about a NOA2 (or RFE) within the next couple weeks. Maybe not....but the odds are in your favor based on the data I've seen. You're not alone in waiting that long.

I only posted "transferred" as the I-797 Receipt specifically states that my I29F was "transferred" from Texas to California and received Oct 28th.... Does this not mean it was transferred? I just recently realized that texas no longer takes I-29f Apps. I will update my profile if this is not accurate to my case.

Hmm...where did it say transferred? I'm, looking at the I-797C and it says "Receipt" for the type, and "...has been received by our office...". Transfers occur after it is assigned to one CSC but then they transfer it to another service center. If you check your receipt number on the USCIS website's Case Tracker, does it say it was transferred? Or does it just say that it was received? But yes, Texas does not process I-129Fs.

Your case has been accepted and routed to the USCIS California Service Center for processing. Within 7-10 days by standard mail you will receive your official Receipt Notice (Form I-797)

Website tracker just says received.... That's all the information.

 

I know it is a 3-6 wait until my fiancée is allowed Entry.

 

I am just seeing similar applicants within the same time frame already beyond and some are already in the U.S. I am just wondering what would cause a delay on my case :(

 

Ugghhh I forgot to copy my original application :(

No need to worry. Yeah, it sucks that some people are already further along than you, but it is what it is. I wouldn't worry about it being something particular to your case or anything like that at this point. Hopefully soon they'll process it.

 

A copy isn't explicitly required. The embassy will have a copy already. It's just recommended in case something got lost or similar so you can give it to them without having to go through AP to resend it or similar. You can print a new copy and use that instead if you would prefer. Making a copy is just easier than re-creating the exact same paperwork in the packet (especially months later).

Routed is something differently from transferred by the way! Routed is being send from the lockbox to the service center who are currently processing the petition. If it's transferred (what sometimes happens at service centers) it'll tell you something like,
"This is to notify you that we have transferred the above application or petition to the USCIS office at: .."

Our petition was right around 90 days from NOA 1 to NOA 2 and you have just hit the 90 day mark, my guess is you will hear something very soon any day now, remember that once you receive your case number you can proceed with the Medical at St Lukes, don't wait around for packet 3 which in come cases never even makes it to the fiance's residence. After you get your case number give it at least a week for your packet to reach the embassy in Manila and then proceed with Medical and Interview. Good luck you guys my fiance is flying to the US this Saturday Feb 4th.

Im on the same boat. I submitted my application 1st week of November. I followed up using the processing times tool and got the same info, that they are currently processing Aug 2016 applications and that my application falls within the processing time so it is not considered "delay". I just figured they are just running a little slow since people tried to send it their application before the election.

All I did was look up my rep online.

For my district.

Colleen Hanabusa for mine in Hawaii.

Her website .Gov had an online application/secure email.

I emailed her my concern and within a day one of her Aids had emailed me with a form to fill out. Basically the form was to allow them to request information on my behalf.

And this is an actual 'Congressional Inquiry' , I sent the form Friday, so I hope to hear back this week.

I was told that USCIS has 2 days to respond to an inquiry of this sort. And the congress woman's aid was on it quick.

 

I just googled her name and found her site.

FYI you can call and make an appt or use mail. 

 

But email is by far the fastest

Update,

 

Congress rep emailed me last week.

And he basically said the same thing the USCIS person told me on the phone.

Super outdated info.

And he told me that California didn't receive my paperwork until November 3rd, although my receipt says October 28th?

So I downloaded a USCIS App, 3rd party and it is giving me updates on Case # that are close to mine... and from California Service Center.

 

In the last 4 days I have been updated on recent approvals from NO1 to NOA2..... 20 have been from Philippines with dates well into November and a few in December.

 

I am on day 105..... I am thinking I should have had some response by now :(

How do I know if mine got transferred to other service center? Fiance is in Qatar. Would it be much easier if he was in the Philippines?

You should base on your received date.

 

Dont worry they are working on it. Join our November filers thread. There are some late October filers That haven't touched yet. We just got our approval today too. We're 14th Nov. You'll have it soon :) someone just got approved today after 113days of wait.
