Traveling while the NVC processes visa application

We recently received our NOA2 but still haven't heard anything from the NVC after 20 days. That's not uncommon right?

 

My wife wants to travel with her tourist visa. Is there any risks traveling between the USA and Brazil at this time? Trumps policies are not effecting this in any way right?

 

she is planning to leave feb 20th and come back march 28th.. so at the time that she returns is there any possibility (relating to the visa application process) customs might stop her? Any step in the process where she must stay in brazil?

You need to call the NVC. Some USCIS service centers send your case to NVC right away, and others wait a few day(s)/week(s). 20 days is a long time!! I would call to see if NVC has received it. Once they receive it, they have 2 weeks to assign you a case number - which will then allow you to pay AOS fee and submit your DS-261 online.

 

As far as traveling, I know it's straight forward for those spouses coming from visa waiver program (VWP) countries (for example, my husband is German and he's visited me during the process with 0 problems) -- but I am not sure if needing a tourist visa affects that. I defer to others who know more about traveling from a non-VWP country than I do!! 

 

Trump's policy does not affect Brazilians - the only way it could affect her is if she happens to have been born/dual citizen with one of the countries on Trump's list.

01-18-2017: Sent AOS and IV package (via electronic processing)

01-27-2017: Checklist received, documents sent back to NVC (via electronic processing)

02-03-2017: Case Complete 

03-08-2017: Interview and APPROVED!

How does NVC contact my wife? Will they send a letter to her Brazilian address? try to call her Brazilian phone number? send a letter to our address in the USA?

Isaac -- NVC usually sends email.

 

You will likely not receive anything from them until you have called and confirmed your email addresses with their operator. You need to be on top of them! They are really back logged with cases right now.

IMPORTANT NOTICE:

Immigrant visa (IV) applicants currently working with the National Visa Center (NVC) to complete their IV applications should make sure NVC has a working e-mail address for at least one party on their case.  (A case party is the petitioner, beneficiary, or agent/attorney.)  If you have not previously given NVC an e-mail address where you can be contacted, please call 1-603-334-0700 to provide your e-mail information.  When you call, have your case number, petitioner’s full name, and the beneficiary’s full name and date of birth available.  NVC will then be able to e-mail you information and instructions rather than send them via traditional mail, which means you will receive items like NVC’s responses to submitted documents and notice of your visa interview appointment more quickly.

Hello Isaac124, I'm in the same scenario as you. I'm Brazilian/US citizen living in the US and my husband lives in Brazil. My NO2 was also approved on the same day as yours January 9th, 2017. You can go to the USCIS and create an account to see the status of our case with the USCIS. You can even register to receive email and text message once your case has any changes. My case says that USCIS sent my case to NVC on January 24th, 2017... I'm going to call NVC this week. They actually don't like for us to call prior to 6 weeks, but I already called and I'll call again every week until I can pass my email to them. They will only take your email once the NVC has your case register in their system. Once you pass the email to them things should move faster. I've heard that you submit all docs online at that point. 

 

As far as traveling to the US with her tourist visa, my personal opinion is not to risk it now that you are this close. Specially at the very complicated moment with this executive orders and etc. Just my opinion... Best of luck with your case. Boa sorte!

I called them today again... took 50 minutes to get to them... they must extra busy with all this executive order ban. Mine is still not there. So I need to call them again. They always ask when was my NOA2 from USCIS, they hate when we call before 6 weeks... I'm in week 3 now and I'll keep calling, even if I make one week sooner I'm happy with that. I'll update my timeline once I get it, in case you want to follow. I'm already following your timeline, so if you update with good news I'll know..

 

I'm assuming that the EO will make them extra busy, but Im hoping that this won't delay other people waiting, like us
