Should we wait because of break before file petition?

I have a question about K1 visa process and break in relationship. Is a gap in relationships a problem to get K1 visa? We started our relationship in 2011 but broke in January 2012 and started over in January 2016. We met each other in person several times in 2016, and collected evidences from last two meetings. So I suppose we qualify for “met in person last two years”.  We are preparing petition i-129f with evidences we “met in person last two years”

But someone told us that as we have gap in relationships then we have to wait till our current becomes two year long and only after that file the i-129 petition and start all this process. Or we should get married and file for K3 visa with no waiting.

So, my question is: is “gap” in relationship a real problem? And we have to have full last two years relationships or get married first.

How much have you seen each other in 2016? I am sure a gap in a relationship would raise more questions at an interview but if you have seen each other a few times in 2016 and have plenty of pictures together I don't see why it wouldn't work. But be prepared to answer why there was a gap in your relationship in the time frame you stated. Is the benificiary from a low fraud risk country? All these will likely factor into the decision of the consulate. But if you have all of your basis covered don't see why it couldn't work.

The forms have 2 specific but different points.

- When did you first meet

- Have you met in person over the last 2 years.

There are no questions about continuation of a relationship.

 

What is important is to check what the consulate/embassy, where the interview will be held at, is like and what they are most likely to require.

I believe questions will be asked anyway. So we will be prepared. And submit more photos and explanations.

We met : 8-13 may 2016, 1-13 August 2016, 27 December 2016 – 2 January 2017

Beneficiary is from Tallinn, Estonia (former member of USSR, in the Baltic region of Northern Europe). It's not Nigeria but it's not a Germany also.

Sounds like you meet the requirements for the USCIS. Now all you need to figure out is what the embassy wants. Might want to check out the reviews and the regional forum for info on that one.
