Hi everyone! I am new to the forum and hope I am doing this correctly. I am an American Citizen and I have petitioned for my husband November 2015 we have been approved for the 1-30 and 601a. We did do biometrics and asked for immigration records from ICE to see if my husband had a record which all came back negative. We continued and everything came back approved including his pardon! Yeh!!

Let me begin by telling about my husband and I'll get to my question. My husband tried to enter illegally in 1999 without inspection, he was caught and he says he remembers that they took his fingerprints and waited a couple of hours at a detention center, never saw the judge he doesn't remember if he signed anything to be released they did take his fingerprints,  he was released a couple of hours later! My husband entered the United States illegally in 2007 without inspection this time he was successful in getting in without being caught, he has been here since 2007. He has never went back. My question is at this point in 99 when my husband entered and was caught they where doing the catch and release like I mentioned my husband does not remember signing anything. So at this point my husband has his appointment for the interview in the near few weeks which I'm really scared only because he doesn't remember if he signed his deportation, can they have other records that are not avail to us here in Texas we checked with FOIA and FBI and no records show up should I be concerned my husband won't get back??

Hi.  

 

There's so much information that could be covered with this and no one easy answer because you two will have to do what you think is best for your family and circumstance. 

 

To start, did you by chance use an attorney for your immigration application and waiver?  Given you're asking these questions now I do not want to assume you didn't  but hopefully they would have given you accurate up to date information about risks.

 

With your request for information from Homeland Security, are you saying his 1999 capture and biometrics did not show up? That he shows no history or that none was provided to you? 

 

I understand that  you might just be feeling anxious and want reassurances, which we all understand but would hate for things to be said here that  exacerbate your concerns. 

 

I hope you get some first hand accounts from people that have had similar experiences and I do hope they are good!
