Timeline

So i am a K1 visa holder, now in the united states, applied for the GC (AOS) 5 days ago I sent my package...I am an IRAQI citizen (Proud to be) ...what do you think will happen to cases like me after the executive order?

Completely unclear at this point and time. While citizens of the 7 Middle Eastern countries cannot ENTER the United States (and there are reports that visa interviews at embassies and consulates abroad are cancelled for nationals of these 7 countries), there has been no official clarification what happens to immigrant and non-immigrant applications for nationals from these 7 countries. I would urge you to contact an experienced immigration attorney and follows his/her instructions.

It's hard to say what will or will not happen, since currently there needs to be more clarification about the order, and who it affects during the immigration process, such as only those abroad or those within the country too. From what I've read, only people from the banned countries who have visas (such as K-1, CR-1, etc.) are unable to enter the country until the ban is lifted. It also appears that GC holders are being refused re-entry if they are from the ban countries.

 

Since you are in the country, I do not see any reason for your AOS to be processed differently. Sure, there is a chance that applications submitted from immigrants who are from the banned countries may be placed in a temporary limbo, similar to the limbo those abroad are experiencing in their immigration journeys. The biggest difference in your situation is that you have already successfully entered from a K-1, whereas others haven't had their interview yet, and are therefore still outside of the U.S.A, resulting in their delays. 

 

I would keep checking your application status and see when it is received by USCIS if you have tracking on your package. I would be on the look out for any notifications that your packet has been received (NOA 1). If a lengthy amount of time has gone by since submission or knowing an officer has signed for the packet you mailed, you could call USCIS to see if they have any information about your petition- if you get a competent representative on the line you could learn if applications are continuing to be processed as normal or if yours/others are being held due to the order. It's just a waiting game, as much of the immigration process is, until more information is issued. I'd like to believe things will continue on as normal for those already in the U.S.A, as I seem to think the 'ban' only affects those who are outside the U.S at this time.

I'm somewhat in the same position as you Haydar, but I have not sent my application yet (Money issues for fees), finally I'm ready to send it and this ####### happens :(

 

I was born in Iraq but my family migrated to Canada when I was young, I'm a Canadian citizen but since I was born in Iraq, I guess I'm also Iraqi by default. I crossed the border from Canada to the US about a year ago legally, now I have overstayed by about 6 months and was hoping to send my application while living within. My wife is American (Her parents are from Iraq but she's American born), we have two children and both are born in the US, I'm so gutted by this news, I can't stand to think not being able to be with my family and not even sure what's going to happen :(

 

I'm not sure whether I should still send my application or not.
