Hi everyone good day to all. I was just wondering if my stepdaughter gets a 10yr green card since I've been married to her mother for 3yrs my stepdaughter is 17yrs old

Don't know on that, good question.  She just arrived and did not process with her mom so my thinking says no.   You will find out very soon.

My vote goes into the no column.

 

I would think she will get the 2 yr card first and then 10 year card 2 years later after AOS and more fees :).

It's Yes. This isn't an opinion. 

 

USCIS uses the same criteria for an IR-2/CR-2 (minor child of a US citizen) that they do for IR-1/CR-1 (spouse of a US citizen). If on the day the child/spouse enters the US and becomes an LPR the underlying marriage has lasted for at least two years then they receive a ten year green card. If less than two years then it's a two year conditional green card.

Liking facts more that blanket statements, I finally jumped over to the USCIS website, and because of the mother's IR status, the child will have the IR status also and be issued the permanent reside card.  If the mother has obtained citizenship, the child can also, if under 18 at entry.
