Border Agent Kept Vaccination Record

Timeline

My fiance arrived today with his K1 but the border agent did not return any of the documents including the vaccination record. I thought he needed this document for the AOS application.

 

Was this supposed to happen ? They also kept his birth certificate but luckily we have a copy.

1/26/2017 --> K1 visa received

 

Adjustment of Status Timeline:

2/7/17 --> I-485, I-131, I-765 (AOS+AP+EAD) application sent

8/18/2017--> green card received in mail

 

Removal of Conditions Timeline:

5/14/2019 --> I-751 application sent

10/2/2020 --> 10-year green card received in mail

 

Naturalization Timeline:

7/28/2020--> Submitted N-400 application online

2/12/2021--> Biometrics re-use letter received

4/30/2021--> Interview scheduled for 6/8/2021

6/8/2021-->  Approved during interview

6/21/2021-->  oath ceremony - officially US citizen

AOS: 2/7/17 --> 8/18/2017

ROC:  5/14/2019 --> 10/2/2020

The intending immigrant should hand out the "do not open" envelope him/ her got from the embassy with the passport and visa. None of the docs that are inside will be given back to them, they'll go be part of their file with uscis. 

If he handed out any more docs, he shouldn't have, specially if they were originals. 

 

If if he doesn't have a copy of his ds3025 he can always ask another copy from the doctor he had the medical with, or hope uscis won't need a copy.

 No you do not get any of those documents back. The beneficiary is to bring/keep his own copy of the DS3025, birth certificate, etc. any other documents need needed for the USA.  If the medical facility didn't give him one he should've asked for a copy. It may be difficult to retrieve now. Hopefully you can.

Like everyone said, if you don't get a copy from the doctor during your medical abroad, you will not be given a copy from the envelope you hand the border agent. USCIS will receive those documents (that the border agent took at POE) and keep them on file, which explains why you are not given them afterwards. You can try and see if the building where your medical was done would be willing to send you a copy to your U.S address or email. Worst case if they do not send you a copy these are a few options I thought of:

 

If you got all the required vaccinations prior to entering the country, you could probably just type and sign a letter explaining that your DS-3025 was handed over at POE, you were unable to retrieve another copy from wherever your medical was done, and that it is inside your medical files. I figure USCIS has the original anyway, it should be a non-issue, unless they really want you to send them a copy of something they already have :blink: Otherwise you could go to a U.S civil surgeon to get a I-693 written up and submit that for AOS, it's just even more $$$  for you on an already expensive process.

Thank you to everyone for the clarification!

 

The doctor did not provide my fiance with a copy of the vaccination form but rather handed everything in a sealed envelope. We will try to request a copy to be emailed or faxed on Monday. 

 

If that doesnt work welll try writing a letter in the AOS form and see if that works.

Timeline

My fiance did not get a copy from the doctor at the time of the medical evaluation either. I guess they could just get the vaccinations again - I know at least in my area, if you go to a public health department, it's not that costly.

The DS-3025 copy in the AOS package is the "friendly reminder" that you already have all the required stuff done (providing it was marked complete".

It should be in your file already at hand, but sometimes they get lost or overlooked.

When the DS-3025 is not marked as complete you are most likely required to get the I-693 completed and include that in your AOS package.

This form needs to be signed by a Civil Surgeon and put in a sealed envelope (not just closed but actually sealed).

 

The problem is that it is hard to find a Civil Surgeon that is willing to just fill in the I-693 and seal it for you. Most want to do a new physical with is more expensive of course. 

 

Your options are:

- File without and hope for the best (assume they will get the complete file and everything in it is complete)

- Try to obtain a copy of the original DS-3025 and check to see if it is marked complete.

- Try to get a I-693 completed with your available vaccination record and include that.

- Get a new medical done and include that in the package.

 

None of these options guarantees you will not get an RFE and not one option is better or worse than the other. it's just a matter of how much peace of mind is worth to you.

 

I included the DS-3025 since I had it and it was marked of complete. I also had an extra sealed envelope I got from our doctor/consulate that was marked "to be used for AOS"  in case I got an RFE (I never did).

I don't know why people think someone (doctor, embassy or CBP) will hand them the vaccination records automatically? The CBP will never give you one, and shouldn't. The embassy and doctor give you a copy automatically in some cases only - most of the time you have to ask for it yourself. I don't know why people leave the medical without asking for a copy and then get surprised they never got one?

Its written on the ds3025 form that the doctor should hand a copy, so it should be automatic, not needing for anyone to ask one

That doesn't seem to be the case irl as so many people on here say they never received a copy, I also had to ask for it, they would not have given me one otherwise. And especially CBP won't give you one.

He also gave a number to reach the embassy contact so hopefully they will help us sort this out.

Sorry the above was incorrect. The embassy told the panel doctor to START giving copies of DS-3025 to patients, something which he was not required to do at the time my fiance went for his medical exam. :-/ Hopefully we can submit the AoS without needing an additional exam now.
