Hi All! I know that for immigrant parent, he or she can only petition kids that are unmarried and below 21. That being said, my brother in law entered the US with a visa under the approved petition from my mother in law. However, he married my ex sister in law civilly before his initial entrance to US. Considering this, will that be a problem? He is now married to someone else here in US but the previous marriage from the Philippines was not annuled. Having said that, US does not have records of him being married in the Phillippines. If he files for citizenship now, will US consulate be able to track records of him being married back home? Also, if his current wife files for citizenship, can he later file for citizenship under his wife?

Your brother is committing marriage fraud. Why didn't he divorce his wife in PHL before marrying his wife here?

 

He is facing all kinds of trouble. He would not only face deportation but also permanently banned for misrepresentation.

Agreed. He has all sorts of hurdles ahead of him in the future. He is committing marriage fraud. Worse, he did so for the purpose of obtaining entry to the US. Heck, legally he is not actually married to his US wife...and any benefits he received from that marriage (i.e. legal status) are invalid. Not only can he have any immigration petition denied, but he can be deported and have a permanent bar.

 

Hoping that nobody finds out is Russian roulette. I'm going to go out on a limb (not really) and also assume he lied to CBP or on forms when he came to the US, adjusted status, and/or removed conditions (you didn't mention his current status).

 

Anyway, to answer your question...yes, it's possible that at any point that they find out about any or all of his illegal actions.

 

Does his US wife know about his previous marriage and not having been divorced or annulled? If not, hes also committed bigamy. Edit: Wow, my mistake. What she knows doesn't matter. He knows what he's done so it is bigamy.

That's not just a big immigration issue, but he can be put in jail for it. The PH wife trying to enter the US by any legal means she would need to either misrepresent herself by not mentioning him as her husband (which she absolutely should NOT do), or by claiming him as her husband (and raising all kinds of flags with US immigration).

 

If somehow he did obtain citizenship, it could later be stripped as it was obtained via fraud.

 

He is facing all kinds of trouble is putting it lightly.

1. He obtained a green card by fraud. He entered the US on a visa for a single child when he was married.

2. He is committing bigamy. He is illegally married to his second wife. Bigamy is a crime in the US.

3. He can never file for anything based upon his second wife and she can never file for anything based upon him since they are not legally married. 

 

Obtaining citizenship is not a free pass. You can have your citizenship stripped if it was obtained by fraud. Imagine him living here for 15 years, having a family, children, job, etc. and suddenly he is detained and deported. Best he sort all this out sooner rather than later.

as everybody has said, he ruined his life,

 

he committed visa fraud, he has committed bigamy, he lied to the officers at port of entry when he did customs, because he had to enter the country as unmarried and he was married, his second marriage isn't valid

I'm always wary about these posts where the member joins VJ and do these sensational posts from the get go....  

 

You talk about your brother-in-law marrying your ex sister-in-law before immigrating to the US. Someone becomes an inlaw when they marry a relative so either it's your brother and your ex sister-in-law or it's your sister and your ex brother-in-law.... 

 

Whether you're trolling or this is a real post, anyone who behaves like this will have a lifetime ban once US immigrations find out...

Hi All! Perhaps I could clarify further that as a family member I am merely seeking answers to support what I am going to say to my brother in law. It is given that what he did was wrong (and I have told them all along) yet I guess the biggest question here is will the embassy find out about the first marriage if nobody tells them? what are their process? The first wife and my brother in law are technically separated and also she have a special someone of her own. Nobody tried to file for the annulment and wife seems to be okay with brother in law having a new special someone. I appreciate all the answers but perhaps people could also contain the hostility in their tone. And no he did not marry the new wife for the papers. She just happen to be a legal immigrant.

I like how you put immigration fraud and bigamy as having a new special someone.  No one here on VJ will tell u how ur BIL will get away with it. Yes, Homeland Security will find out.

So lost with all these brother-in-laws and ex-sister-in-laws... How does that even work... This is your spouse's brother marrying your ex-spouse's sister? Man... This is all kinds of messed up. The way you say "she's okay with him having a new special someone" made me giggle though. It really doesn't matter if she's okay with bigamy, it's still bigamy and that's punishable in almost every country. 

 

Long story short, your friend has no chance of staying here, he is out of status. Might want to look for jobs back home - and perhaps a lawyer to see how the bigamy will be seen by the PHL government.

Technically isn't the same as legally. And being separated means nothing in the eyes of the law.
