RFE help!! AOS financial docs

Despite my best preparations and countless hours on this site, I just spoke with NVC today and found out that I have an RFE coming my way. :(

 

I am an electronic/email processor and have not received anything about it via email yet -- so I'm wondering how long others in my situation had to wait for a checklist to come?

 

The very nice operator at NVC said that I could send in the documents they needed right away (they want an i-864a since my joint sponsor is in my household... even though I was under the impression I could send in two i-864's...they also want W2's for me and my father, even though both are self-employed and we don't have W2s...but anyways). She also said that I could just wait for the checklist email, which is what I'm going to do.

I got an RFE and am a little confused about how to best respond - please help!! :)

 

I am an electronic filer, so will be emailing the documents back to them. First part was easy to understand, they wanted my joint sponsor to fill out an i-864A instead of i-864 because we have the same address and are related. Second part is a bit more confusing -- they wanted me to send W-2s for tax year 2015 (even though they have the full tax transcript, I thought this would be unnecessary). Here is where I am confused --

 

1. I have the W2s, but I also have 1099s for 2015. Do I need to send those as well? Remember they have the tax transcript already.

2. Does my joint sponsor need to send W2s for 2015 also (it only asks for mine in the letter specifically)

3. The RFE says that we must send in all documents requested to the NVC before an interview will be set up. It ALSO says that the applicant should bring the W2s to the interview and not send them into the NVC. What gives?!!

 

Here is the exact text from the letter:

On the attached Affidavit of Support checklist, we have put an "X" by each item you need to correct. Go to the Department of State's website at http://nvc.state.gov/aos for English or http://nvc.state.gov/aos/espanol for Spanish and follow the instructions for the Affidavit of Support form(s). From there, you can fill out a new form, sign, and send the form(s) to the NVC. We require an Affidavit of Support form for each case regardless of your income level.

Your case is on hold until you send us the items we need. When you return the documents and completed Affidavit of Support form(s) to the NVC, please make sure that the documents are in the correct order, as stated in the I-864 Important Notice instructions.

For Affidavit of Support (FAQs), go to

For electronic processing, all forms and documents that we request and require from you should be scanned and e-mailed to NVC as Adobe Portable Document Format (PDF) files. Forms and documents should not be mailed through the postal service. The applicant must present all original forms and documents to the Consular officer at the visa interview. Any questions regarding your petition should continue to be directed to NVCElectronic@state.gov.

PLEASE NOTE: No interview will be scheduled until ALL of the information requested has been emailed to the National Visa Center.

Hi, once you submitted the 864 instead of the 864A it automatically triggers the other responses as none of the the documents were accepted so the way the system reads its as though you did not submit them. Just submit the 864a as they require with the same evidence and you should be fine. If you do not have them you can submit the tax documents where you retrieved the transcript. I think it says w-2 information. Yes your sponsor needs to send their w2s as well.

However, I'm still a little perplexed if I need to send the W2 in with the updated i-864A's OR if I should give it to my husband (he's the applicant) to take in with him at the interview?? I also have 1099s for 2015 and I don't know if I should send those too or not since they didn't as for them specifically.

 

The RFE gives conflicting information but I don't want to mess it up and get denied. So confused!

Where's the part where it says your joint sponsor needs an I-864a?  All I see is that they want the beneficiary to bring w2s to the interview along with the AOS and other docs.

 

BTW from the NVC this is called a checklist.  An RFE is only from the USCIS.

Joint sponsor is my father, he does not claim me on taxes nor am I their dependent. My father also files jointly with my mother - so we submitted an i-864A for her and an i-864 for him.

 

We all live in the same house though. It seems that NVC is interpreting "household" to mean same address in my case.

I don't know... everything was filled out completely and correctly. When I called to talk to NVC on Thursday the operator said that they wanted my father to submit an I-864A instead of the I-864. (this was before I had received the hard copy checklist) I thought that as a joint sponsor he could submit either the I-864 or the I-864A, even if we lived in the same house.

 

I just don't want to send the wrong thing. Its also confusing because it says at the beginning that ALL documents requested in the checklist must be sent to NVC, but then it says that my W2s should be given to the immigrant to take to the interview. :bonk:

Circling back to this thread to update with the outcome.... 

 

I ended up taking the NVC operator's advice and re-submitted the I-864 for my joint sponsor (my father) as an I-864A, then corrected the I-864A for my mother to have me (the petitioner/main sponsor) listed on her form instead of my father. I also sent in a W2 of mine from a previous tax year that I had forgotten about. Everything was accepted within 1 week and we got a case complete!!
