I-751 Questions removing conditional residency

My wife and I are looking to remove the conditional residency of her greencard via form i-751. I went to file for 10 year greencard, but it said if you're a conditional resident you have to file i-751 to remove the conditional residency restriction. Couple of questions hopefully someone can shed light on.

 

1. After the 2 year residency restriction is removed, do you then have to file for 10 year greencard, or does it turn into a 10 year greencard? I've looked everywhere and not found the answer to that question.

 

2. The i-751 is ready to go, i'm working on evidence. The house/cars are in my name, the only things in both of our names are bank statements, auto insurance, and health insurance. Will that be sufficient?

 

3. It says we have to submit a biometrics fee, even though we've already done that 2 years ago. Is that the case? I'm not going to jeopardize the greencard to save $85, i just want to make sure, because I'm sure if you overpay, they're probably not going to tell you.

 

4. Does anyone have samples/examples of sworn afidavits of people knowing us?

1) I think you're a little confused. By removing conditions, your wife will receive a GC with 10 year validity. 

 

2) It's a good start. Make sure you show statements from the duration of your marriage. Check out the guides/forums here for other examples of evidence to include.

 

3) Yes, it must be submitted. Biometrics are taken multiple times during the immigration process 

 

4) These are not necessary.

If it isn't difficult, it isn't worth it.

12/30/16: Notice of interview scheduled (day 109)

2/1/17: AOS interview (day 142) - APPROVED

2/8/17: GC received (day 150)

11/3/2018: ROC window opens

The end result of filing for the removal of conditional residency is that you get a NEW greencard which is valid for 10 years.

You have a pretty solid list, but here are some extra things you could send to improve your application further:

  1. Have you filed taxes jointly? Send tax transcripts.
  2. Are you guys on a lease together? Send a copy of the lease.
  3. Are you guys on any utilities together? Send copies of bills
  4. Send 10-15 pictures of you thoughout the last two years.
  5. Take any vacations in the USA together? Send copies of receipts, boarding passes, etc.

Procedures regarding interview/biometrics have been in flux. Just do whatever USCIS tells you to do.

Don't bother with this. Presumably you guys have been actually living together the past two years and should have a ton of paper with your names on it. The only thing I'd recommend is to have a joint statement from the both of you basically describing your life in general detail over the past two years. Sort of like a story.

Thanks much for the advice and clarrification. I have 3 years of tax returns with both our names on them. I have owned the house for 10 years, we met 6 years ago, never bothered to add her name. We bought her car new but it's in my name. We hit disney last year, myrtle beach the year before. All utilities are in my name.

 

Can we change her first name during this process? We had the chance for the first greencard, but she wanted to stick with her name that no one can pronounce. Now after a few more years of that she's ready to change.
