Right now I have a work visa application that is in Administrative processing. I have been told that this will take roughly around 90 days to be resolved, sometimes shorter sometimes longer.

 

The question I have, if anyone knows, while the work visa is in administrative processing could I apply for a fiance visa and cancel the work visa application or do I need to wait for the work visa to be approved or not?

 

Any help or understanding would be great.

Well why are you immigrating?  For work or to marry your fiance?  Do you have an American fiance?  Were you planning marriage?  Are you doing this to circumvent AP for the work visa?

Is that you believe you can have a K1 visa within 90 days?    

Your profile says you've filed for a K1.  I think canceling one visa and applying for another would look very suspicious.

I am immigrating for both really. I have been working there since 2009 and just got engaged in December. I had hoped that I would have been approved for the work visa by now and then we were going to discuss when and where we were going to be married. We had initially spoke about a September wedding.

 

But now those plans have been put to the decide and we are trying to figure out the best way for me to secure my future in america with my fiance and spend as little amount of time away from each other. She is an American citizen. 

 

I haven't filed for a K1 visa yet but was looking for information before doing anything.

While it makes sense to me, it will look suspicious to USCIS/visa officers who already scrutinize and raise eye brows for every little thing. Ultimately, a K1 visa can take anywhere from 6-8 months from what I understand. After that, you'll still have to go through administrative processing even with a K1. So if anything, you'll just be extending your waiting time even more. I think you're better off just waiting for the administrative processing of your work visa (I'm assuming the H1B?) to be finished. Being that you're from Ireland, it shouldn't take super long. I'm hearing a lot more cases now of people complaining about administrative processing and how its taking a lot of time. Not sure if this pro-longed wait is something new, part of a new "extreme vetting" mechanism or what exactly to be honest.
