Honestly though, this executive order BS is one thing - but what is the legal persepective? Congress MUST get a say in this at some point? Executive orders must be challengable in court? Or will this run its course for 90d and then go back to what the law prescribes?

 

I am not as well versed on the US legal and political system as I would like, but naively viewed, barring legal residents on basis of their religion goes against the constitution and is blatant discrimination? I need to go read up...

Iranian green card holders who live in the United States were blindsided by the decree while on vacation in Iran, finding themselves in a legal limbo and unsure whether they would be able to return to America.

“How do I get back home now?” said Daria Zeynalia, a green card holder who was visiting family in Iran. He had rented a house and leased a car, and would be eligible for citizenship in November. “What about my job? If I can’t go back soon, I’ll lose everything.”

This scares me. My girlfriend is in South Africa, which is not on any of these lists, but this means they could still do this to any green card holder. When she does get a green card, do I forbid her from visiting her family for three years until she is a US citizen in case they block her from coming back? This doesn't just affect illegal immigrants, as so many pro Trump people have been claiming, this affects me, a US citizen who is dating a girl nowhere near any of these countries.

I think a former president did something similar (Jimmy Carter), but not to this degree. It was waaaaay before my time so I'm not too familiar with what happened and what the result was.

 

Also, from what I can tell it'snot based off religion per-say but rather origin of citizenship....it doesn't make it any less terrible though.

Even though executive orders are not mentioned in the constitution, they have been used by every President since George Washington—and more often in times of war or during national disasters when government policy needs to work more quickly than the traditional legislative process. Sometimes the Supreme Court has stepped in to rein back Presidential powers, like when Harry Truman tried to use executive orders to have the government seize America’s steel plants in the 50s.
 
Presidents have increasingly used executive orders to make policy that circumvents Congressional control. In recent years, George W. Bush used executive orders to approve more aggressive surveillance after 9/11, and President Obama has used them for several things, including immigration reform.
 
While executive orders can be an essential tool for Presidents, some fear that their increased use threatens the long-standing checks and balances set up in the Constitution. In that system, Congress makes the laws, the Courts interpret the law, and the President and the executive branch enforces the law.
 
So if a president is issuing an executive order it really means one person is making a decision for all Americans, without input from Congress, state legislatures or Courts, and it can be just as easily changed by the next president with the stroke of a pen and no input from anyone else.

I can explain it to you. But I can't understand it for you.

My husband is Iranian and applied for U.S. citizenship in May 2016. Once he finished the biometrix appointment we haven't heard anything back. Will my husband not be able to get citizenship because of the law Trump just passed? What do we do now? Should we get an immigration lawyer?

I'm not sure what will happen in regards to applying for citizenship....all I can say is avoid leaving the country for the time being :(

It should be fine, the law does not affect citizenship. Honestly I don't think they will expand it that much either, I think this was the big "immigration bill". However, DO NOT LEAVE THE COUNTRY. If he leaves he won't be allowed back even if he has lived in the US with a greencard for years

My two cents.

 

The ban is temporary. The ban is not actually a Muslim ban as the liberal media describes it because there are many Muslim countries not included in the ban. Regarding green card holders, gc holders will be reviewed on a case by case basis. Remember, there are green card holders who serve in the military. But I think this is the biggest potential concern because although the customs and border patrol agent will likely allow a military green card holder to enter, however it doesn't matter if he/she never makes it to the agent, meaning if the transportation carrier never even lets a green card holder board at the point of origin, then its a de facto green card holder ban as well.

Temporary or not, the flag is in the system.  What's to say that it doesn't get extended?  People will likely lose jobs because of this.  Then what?  Is the government going to look after that for them?

At this point, if you're not from one of the 7 listed countries, there's no need to worry.  I'm quite surprised it extends to GC holders, but it seems to.   The president has pretty obvious authority to block visa holders from entering, but GC holders have more rights.

 

If you are currently in the US and from one of the 7 countries, do not leave under any circumstances.  

 

Having just had my partner get his visa yesterday, my heart really goes out right now to those of you that are affected by this and may not be able to be together soon.  I'm sorry for the behavior of my country.
