To preface, I work for a non-profit that helps resettle refugees so I hope to provide a couple of things that we know since our office communicates with the Department of Homeland Security.

I am copying their message last Saturday:

STATEMENT BY SECRETARY JOHN KELLY ON THE ENTRY OF LAWFUL PERMANENT RESIDENTS INTO THE UNITED STATES

 

WASHINGTON – In applying the provisions of the president's executive order, I hereby deem the entry of lawful permanent residents to be in the national interest.

 

Accordingly, absent the receipt of significant derogatory information indicating a serious threat to public safety and welfare, lawful permanent resident status will be a dispositive factor in our case-by-case determinations.

This means if you have any arrests, or had have any problems with immigration in the past, you may  be at risk of being stopped. 

There is another clause in the Executive Order that allows for the denial of nationals from countries that do not comply with requests for information from the U.S.  It is possible that other countries (including my birth country- Philippines) could eventually be on this list, but the procedure laid out in the order indicates that there would be at least 90 days before any of these bars would go into place.  That said, there is no way of knowing exactly how the order will be implemented (e.g. CBP could apply it unevenly from port to port or the order could be interpreted differently that what is laid out in black and white which is what's happening right now, some planes letting those 7 country ban nationals get onboard, some are refusing etc). 

At this point, there is really no clear direction and all we can do is wait so everyone please be careful . As an immigrant myself and having a husband from the Middle East, I have this number saved on my phone so please have this too: 888-769-7243. This is the NY hotline to report family members or colleagues affected by the travel ban. I hope this helps!

I obtain 10 years GC, my country of origin is Thailand, Should I apply for citizenship now or should I wait? I will reach my 1oth year is about 6-7 years from now. I have been hearing so many concerns:

 

To do it asap because...

-You will never what could happen, just get it out of your way.

-They could revoke, deport, or denied you as a greencard holder.

 

Not to do because...

-The process takes months, and anything could happen, you don't want your case to be left open in the middle of the situation.

-IMMDEFENSE.ORG recommends those who has greencard to avoid contact with USCIS, don't try to change the status now, don't try to change your name now and etc. and lay low.

OK that's just plain paranoia. If you want to be a citizen, by all means apply. If not, don't. That's the simple way to answer your question.

If becoming a U.S. citizen is something you wish to do, then I would think about doing it. 

 

-The process takes months, and anything could happen, you don't want your case to be left open in the middle of the situation.

 

While the process can take a while and does involve a cost as well as the civics and English exam (waived in some cases) you are in no risk of losing any status even if your application does stall. There is no current** legislation that would effect your green card in any way. If it get stalled, you become a permanent resident with a pending naturalization claim, versus just a permanent resident.

This doesn't seem accurate, unless they are talking about people who are currently out of status and have no clear claim of citizenship. No current** legislation will penalize you for applying for naturalization. 

 

The decision to become a U.S. citizen is something I see as a very personal decision sometimes. But the way I see it, if in the midst of this nonsense you STILL want to stick with us then by all means, take the step that could very well protect you, and also lets you (better) participate in the government that is making all these decisions.

Agreed 100% major paranoia.

 

I would apply immediately if eligible.

 

When my parents came to the US from Canada on a work visa they applied immediately after the 5 years because if my dad ever lost his job they would be sent back.

 

And I plan on doing the same in two years, it could be considered risky not to. Anything can happen, remember immigration is a privilege and not a right.

I know there is a lot of misinformation in the earlier posts in this thread but hopefully people are caught up in understanding that YES even LEGAL PERMANENT RESIDENTS are being turned away at this point. I have clients who I know personally who are getting caught up in this and am advising certain others, even from countries not currently on the ban list but have contention surrounding them, to be mindful about leaving the U.S. with the new administration since things can turn on a dime over night. 

 

A number of people disagreed with me in the original Trump thread and were convinced that any changes would take time and congressional cooperation. I hope that at least what comes out if this is people wake up and realize how serious this is... 

Can you provide more info regarding that? I am a GC holder from India, born in Kuwait.

It's pretty simple.

He can do an EO to add more countries at any point. If you feel your country has a chance of being added do not leave our country until this is ridden out.

It looks like GC holders need to apply for waivers in order to be permitted to enter and go to their own homes... This waiver is just to make sure the GC holder is free from any "derogatory" information, whatever that means...

 

Where would you apply for this waiver? Is it something you need to do from the Embassy prior to leaving or is it something that gets done at POE?

 

Also, i have heard accounts of people being detained, their cellphones confiscated, unlocked, their social media posts reviewed and laptops reviewed as well. This is for both US Citizens and GC holders.... is this actually legal? can the CBP legally do such a thorough invasion of your privacy?

This is standard for secondary processing for suspicious people at CBP. See Border security on Netflix. I had no idea they could ask to see your laptop or mobile phones, texts etc

 

However, now, I am guessing they will be doing this a lot more?

I suppose you could mention it to them if they tried to go through your laptop.  Once again anything goes when you enter our country.

US is my country as well. So yes, our country.

 

And  I did mention above that it is standard for them to go through phones or laptops during secondary processing if the person appears suspicious. Border security is an excellent show that highlights how hard CBP, DHS work. I cannot imagine how they process so many people in one day.

I need a sincere advice from everyone. I'm a citizen of United States and we have planned to visit Pakistan this February. My husband is green card holder from Pakistan. As of present situation, I'm confused whether it will impact on us or not. Though he is traveling with me and I'm gonna with him when entering back to the US.

That's a tough one. Personally, I would not travel yet. Give this some time to see where it goes. Different parts of the administration are saying different things about who is and is not impacted and how. IMHO, only time will clear up the mud.
