Thank you for your words and the advice. The embassy website in London and NVC website states the same thing. That whether you are a national or dual citizen you won't be given a visa, contrary to what Boris Johnson has announced yesterday.  I have emailed ACLU and the embassy in London and waiting to hear.

This is certainly not the same as some CBP officer not fully understanding a rule. This is the President of the United States signing into effect an executive order without proper planning, without taking in advice and without giving ample time for the decision to be implemented.

And yet some of them are now in contempt of court orders to suspend the ban.

It looks like GC holders need to apply for waivers in order to be permitted to enter and go to their own homes... This waiver is just to make sure the GC holder is free from any "derogatory" information, whatever that means...

 

Where would you apply for this waiver? Is it something you need to do from the Embassy prior to leaving or is it something that gets done at POE?

 

Also, i have heard accounts of people being detained, their cellphones confiscated, unlocked, their social media posts reviewed and laptops reviewed as well. This is for both US Citizens and GC holders.... is this actually legal? can the CBP legally do such a thorough invasion of your privacy?

I suppose they could go through your privacy if they felt the need too. If you have nothing to hide it should not matter.

9/16/16 - DS260 Finished!

9/27/16 - Sent Documents to NVC.

11/21/16 - Called NVC. Case reviewed and accepted on 11/18. Waiting for email/mail.

11/28/16 - Got Email stating we are now waiting for an interview spot!

12/11/16 - Got the interview date! 1/12/17!

1/12/17 - ...ACCEPTED SHE IS NOW WAITING FOR HER PASSPORT IN THE MAIL! =]

1/18/17 - Passport and visa in her hands! We now wait till 2/24 for her to fly to me! (Has to finish work contract)

2/24/17 - She is now here with me! POE was simple,she only took 10 minutes with them checking her visa! "Welcome to America,missus"

It seems that being critical of the president is "something to hide" now.

its one thing to not have anything to hide, its another thing giving up your entire life to a CBP officer and trusting them with sensitive info that isnt any of their business. Privacy is a thing...

 

Regardless, i am wondering about the legality of it. I find it difficult to believe that they can do this to US Citizens. A cop cannot just come up to you and confiscate your phone, look through your email and your social media without a court order.

It is absolutely legal. There may be some limits for certain classes of people (i.e. USCs or LPRs)  that can be argued in court, but in general you are not entitled to privacy when requesting entry to the US.

 

Edit: That said, I find it laughably ineffective. If there's reason to believe they will check your social media and phone for derogatory information, then would-be terrorists simply won't put that information on their social media and phone.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..
