I cant see what visa you came on since I'm on from my phone. But basically you can stay together and you can file or you can divorce and go home. 

If you tap in his profile name it takes you to his profile so you can see that info.

If you remarry in good faith, you can refile for AOS. That said, you need to divorce first (which may take years to finalize), and it will look *very* suspicious to USCIS. If you're asking about marrying just to get a GC (which is what it sounds like you're thinking), then no...that's fraud and not allowed to be discussed or condoned on VJ.

Hmm... If you've been married for a year, why haven't you applied yet? This makes me think it wasn't just for a GC. But you asking if you can remarry immediately does sound a whole lot like immigration fraud and if we're saying that here on VJ, trust me USCIS will think it too!

N-400 Application for Naturalization

Day    00 - 08/31/20 - Submitted online N-400 application. ROC still pending. Requested combo interview.

Day    01 - 09/01/20 - NOA received online. Status says biometrics appt letter will be sent. (PD 08/31/20)

Day  141 - 01/20/21 - Biometrics reuse letter

Day  233 - 04/22/21 - ROC approved, no news on N-400

Day  288 - 06/18/21 - Interview scheduled

Day  332 - 07/30/21 - Successful interview. No decision yet.

Day 758  - 09/28/22 - Oath ceremony will be scheduled

Day 870 - 01/18/23 - Oath ceremony complete
