Who would be the eligible relative that would be AOS from???

 

Your hubby whom you are divorcing is the only qualified person in the US.

VAWA and AOS is filed by me, myself and I... its a self petition. I dont need him for it... its in the main description of the VAWA on the USCIS website.

No you can't go on VWP and adjust.

 

Look I'm not trying to be mean in any way so don't get it like that but you seem VERY desperate to come to the US to live again and hey I get that but sometimes you have to step back and not be so desperate that you will do pretty much anything in order to get there.

Again i dont see how everyone is getting so confused after i thought i put it so simply before. I look desperate because im getting grilled by everybody that is confused, so im answering multiple questions at one time. Im not sitting here and arguing with anybody over the internet, lol. I'll call the consulate on Monday and see if the above information i provided links to is accurate, so i know im not getting misinformed again. As for any other information regarding my son and my husband, well lets just leave it as it is, ya'll dont need to know anything else. I know my intentions are honest, legal and fair. I dont have to justify myself to people on the internet that are doubting my story. I'll keep in contact with Sandra to see if she has any input.

EDIT: just saw the comment about evidence for VAWA. Yes i have evidence.

6 police reports, 2 military police reports, temporary protective order, record of submitting a weapon to the police departments lockbox, 4 witness accounts, picture evidence of physical bruises, cuts and broken bones, pictures of the multiple times my apartment was trashed by him, record of investigation with the us military into domestic violence, text messages threatening my life, text messages threatening abortion and admitting to hitting me on several occasions, an official letter from my therapist explaining my situation and that im receiving therapy for domestic violence related PTSD, pictures of my car windshield after he kicked it in, videos of him attacking me, hospital discharge paper from a broken sternum.

The only person you can AOS with is your husband. And you have a VAWA case against him.

 

To many that would seem strange because you said earlier you don' t want him to know you are trying to gain permanent residency.

 

So AOS on VWP is out.

AOS gets filed jointly with VAWA at my discretion. No "3rd part lover" involved.

am i wrong in reading that VAWA and AOS is a self petition and he has nothing to do with it? or is that not how the "violence against women act" works?

It is true that a VAWA will be self petition without the other part.

 

You have to have a really strong case with evidence from hospital, police and so on. Just saying you had to go home because that and that  won't do you good.

 

What confuse people is that you have brought up so many different thing for example you immediate relative as if you wanted to AOS through him.

I apologise for the confusion, so many people were saying so many different things and asking different questions it overwhelmed me and i guess i went a little too far into details and got ahead of myself. I do have solid evidence... i wrote a list of what i have in my previous comment. police reports, a hospital discharge paper, pictures of injuries, pictures of my trashed apartment on different occasions, messages admitting what hes done, proof of his adultery, nasty emails, texts, etc... multiple detailed witness accounts, and a psych evaluation and descriptive letter from my therapist about my domestic violence PTSD

it comes down to you didn't have to leave the us you could have moved to another state and never seen him again. you chose to go back to the uk. then you missed the window to remove conditions which you could have done as divorced easily with evidence of abuse your residence was terminated since that was one of the conditions of conditional permanent residency. one of the requirements to be a lpr is to live in the us, you chose not to for that reason you would not regain residency.

 

please call the embassy and tell them what happened they should know better and can advise you on how to proceed.

She didnt even need evidence of divorce if she could prove abuse.
