Let me start by saying that our petition went into AP for proof of the children being his so we sent in the BC of the children and now they are saying our relationship is not bona fide and that they were sending it back for revocation recommendation. Is there any type of appeal that can be done? Cos I have been there twice in 2 years and stayed 3 weeks each time. They have the pics and plane itineraries.  I don't understand how they can say it's not boafide. How do I appeal? Or can I appeal.? It's k-1

Children are not proof of much honestly (no offense intended), it just shows two people had sex.

 

As to appeal, I've heard you can; but it is costly and takes a long time, so probably not worth it...

 

Probably is best to send a withdrawl of the petition to the embassy and the USCIS, then you can either refile the I-129F, or marry and try for CR-1; but first you must figure out exactly what went wrong and why it was denied, or the next interview for K-1 or CR-1 would also get denied.

I don't have children with him.  He had to show proof that the kids that he was bringing was his.,snd then when that was proven that is when they said our relationship wasn't bonafide. We didn't go into AP because of a question of bonafide. We went into AP because he did not have the children's birth certificates

Are you trying to bring the children with him or are they staying?

Sorry this happens to you. How many children does he have? Is he the legal guardian of them or a single father? Why didn't you apply for visa for his children together with him, the could get visa and follow him during 1 year. Maybe the embassy is thinking you and your fiance don't care about children and it's not the real relationship because of that?

Really sorry to hear. Was afraid to see this after all the delays.  Now for your case there's nothing  to appeal. You would be battling trying to prove Immigration (DOS) made a error. I would say because of the children a K1 doesn't show bonafide relationship. Your best recourse is to be married.

 

The K1 will be sent back and expire. So I would get over there marry and file a I-130. Hopefully this time next year he will be here.

I did apply for the kids to follow later, that's why we had to prove that they were his. If the kids were not his they would not be able to follow

Oh! It's weird! My fiance just got his visa in December, him and his baby but the medical asked him to do the DNA test

The children had nothing to do with the denial he had already proven that they were he is they later came up with the decision that our relationship was not bonafide
