applying for step daughter and grandchildren

Hello all,

 

         Question how do I apply for my step daughter who is 22 years old and her 2 children? She is unmarried. I am thinking of applying for her and the grandchildren after my wife is approved.

You may want to consult with a immigration attorney, due to the fact your step daughter is 22,   from what I know, a step parent  relationship had to be established before her 18th birthday.

Delivered: Sept. 15th 2016 to Chicago Lock Box

Interview Feb  21st, 2018 for I-485

Interview  May 13th, 2019 for I-130 Stokes interview ( 2 minutes)

NOID issued May 17th 2019

June 5th,2019   USCIS received my response on the  NOID// Addressed the NOID myself, No lawyer ever used in case.

July 1st, 2019  10 YEAR GREEN CARD APPROVED

July 5th, 2019   Approval letters for I-130 & I-485 received in the USPS  mail.

July 11th 2019   Green Card in Hand

your wife as her mother will have to file for them, there are no derivatives for immediate family members

 

so if you are a USC, you can file for her if the marriage took place before she was 18

 

but if she wants to come with her kids, since you can't bring them as derivatives, your wife will have to file for them,

 

depending from where they are, it would take over 6 years of waiting, since she is already over 21, maybe more depending on her country of origin

Yes I am a USC, but the marriage was after yes had turn 18. How can I find out the estimated wait time for her country Colombia?

so you can't file for her,  her mom when she becomes a LPR can file for her, it will take over 6 years and she has to remain unmarried while her mom is only a resident. she can only marry after your wife becomes a USC

she will be under F2B, unmarried child over 21 of a LPR, legal permanent resident
