Hey All,

 

I'm currently waiting for my I-130 approval, but have started to look into getting my documents together for NVC stage. Here's my current question -

 

I'm a post-doctoral scientist at a research university. My salary is paid as a fellowship by a private foundation, and as such there are no taxes withheld and more importantly, there is no W2 form ever provided. Now, the AOS form (I-864) states you can provide tax transcripts, and I already have mine for the last 3 years. However, for the tax year 2016, I will need to file my taxes jointly (since I got married!!), in which case, I need to provide proof of my income which is separate from my wife's. Everything I've seen on VisaJourney says to provide a W2 form. But I don't get one!!! Here's what I'm thinking I'll provide --

  1. Tax Transcript for 2016.
  2. In my cover letter, describe why I don't get a W2 form.
  3. A letter from the private foundation, as well as my university, stating what my salary was for the year 2016.

Anything else people would recommend?

That sounds fine - but I would consider including a 1099-MISC, assuming you get one?

 

This is the form that you get for work that falls into the "contract" category -- where your employer doesn't withhold and you are responsible for all taxes. Anytime you earn more than $600 from an employer as a contractor it triggers the creation of a 1099. This sounds like the situation you described.

10-27-2016: Case sent to NVC

NVC Stage

11-03-2016: Case received by NVC

11-14-2016: NVC case number assigned

11-16-2016: Welcome email received, DS-261 completed online

11-17-2016: AOS bill paid

11-18-2016: DS-261 reviewed over the phone

11-20-2016: IV Fee Invoiced, IV Fee Paid

12-26-2016: Completed DS-260

01-18-2017: Sent AOS and IV package (via electronic processing)

01-27-2017: Checklist received, documents sent back to NVC (via electronic processing)

02-03-2017: Case Complete 

03-08-2017: Interview and APPROVED!

04-21-2017: POE Philadelphia
