Hi all,

I am trying to decide if I need a co-sponsor for my adjustment of status paperwork. My salary should be enough, but I only started working recently after graduating from college, so I don't have tax info from before. We used a co-sponsor for the K-1 interview, just to be on the safe side. How closely will they look at this second round of support documents? Do I need to submit co-sponsor paperwork again?

Thanks everyone!

Diomedes,

The USCIS will look very closely at the financial information for sponsorship.

If you are concerned, submit your own I-864 package and one from a Joint Sponsor as well. If the case officer is satisfied with your financial standing they will return the offered Joint Sponsor's unnecessary I-864.

My husband earned enough for the past year, but not for the past few years, he had been in college the past couple of years, your tax returns need show that you've earned above the poverty from at least the past 3 years. If you do go through with a co-sponsor this time round, make sure you have absolutely everything from the co-sponsor, go over all the instructions USCIS asks what they want from the co-sponsor, we got an RFE, as we had forgot to put a letter from our co-sponsors employer in the packet, saying what their job entitled, how much they earned, can they go any higher in their position, how long they have worked for that employer, and 6 months worth of pay stubs. So be very well prepared, to be on the safe side I would go with the co-sponsor, there is no harm is doing so.

And don't forget that although the instructions don't specifically ask for the supplemental information (employement letter, bank statements, etc) you will probably get an RFE for it if you don't include it. So better to just send it the first time. Of course, they'll probably RFE you anyway for the stuff you already sent in

your tax returns need show that you've earned above the poverty from at least the past 3 years.

This common rumor is actually not true.

There is a requirement to present your last X years' tax returns (offical linie is one, people are often required to turn in 3).

There is another requirement that your current income be at/above the poverty guideline for your family size.

There is no requirement that any of your past years' tax returns be at/above your PG.

That, fortunately, is not true. They don't care how much you made 3 years ago, they care how much you made last year and are currently making, that's why it is suggested you submit letter from employer stating current salary or last 3 - 6 months of pay stubs.
