Cheating does not remove the sponsor's obligation under the Affadavit of Support; the only things that do are death, gaining US citizenship, or loosing the greencard..

That's what Penguin wrote. 

I think it absolutely helps OP to know that fighting to retract his affidavit of support given what he has told us about his situation will be wasted time and energy. That is unless the relationship really wasn't bona fide in the first place.

They're going to have to get legal support for the divorce anyway, it really wouldn't hurt to say "hey can you look into what I can do about this" to your lawyer. But if you insist it's absolutely pointless to explore this further, I respectfully retract my suggestion. ^_^

If it's the same guy, you should really consider who she really loves/wants...

 

Few years ago, I was dating a non-Indian girl, who I thought was cheating on me with her coworker ( she wasn't, however she was very touchy touchy)

 it ruined our relationship. The trust was gone. The relationship dragged on for like 13 months. And we broke up. I wish I left the relationship earlier.

 

So remove the emotions, her beauty/looks for a second and think hard about it...

If you can't trust her, move on.

You and Penguin are not saying the same thing.  Since you asked to be corrected if you are wrong, then accept that you are wrong.  There is no "hearing" and you can't get out of the AOS for cheating.

 

Dangling the false hope of getting out of the AOS because of cheating does not help the OP..  It creates confusion and waste his time.  Penguin giving him the correct information helps him.  You insisting that the two of you are saying the same thing when you are not hurts him.

OP has not mentioned anything in the way of evidence to support a claim of Fraud for immigration purposes. Getting divorced is totally different.

Alright, allow me to clarify then. I only meant that Penguin and I both said her removal of conditions will likely be granted in case of a divorce.

 

The part about maybe getting out of the affidavit of support, I said "I'm not sure" - but after everybody else has commented on this, I said "I respectfully retract my suggestion"

 

I don't know why this is still going on at this point. 

 

OP, listen to Penguin. I wasn't sure about it anyway, I stand corrected.

Emotion is playing a key here. I am furious but also attached. Hope you understand.

So if you truly love her and have forgiven her just let it go.  Don't waste your time "delaying" her citizenship.  You really can't unless you divorce her.  But why would you divorce her if you have forgiven her and your desire is to be with her anyway.  Get over it or divorce her and move on!
