K 1 Visa married in august but haven't filed adjusment

Hi, I need help

My husband and I were married in August 27th 2016, on a K1 visa. We are going to file this month for the adjustment of status should that be an issue? Also, his son was added on the petition and he has a visa K2 but we havent sent for him but we would like to go get him. I think we have up to a year to get him and that will be up in March. Do my husband need to file the adjustment of status first before we file out the application for his son visa. I hope I said this right.

No problems. As long as you were married in the 90 days which is required by K-1. If the son has K2 visa he can come but Your husband will probably not be able to get him without an Advanced Parole document as he will be out of status technically and he has overstayed, which at this time is taking roughly 90, days.

Yes, but he brought his daughter with him so I have to do a 485 for him and his daughter. The son is still in jamaica. So wouldn't I need to file out the visa application for him?

Please can someone help me out. All I wanted to know can we get my husband son. My husband is her on K1 visa but it expired in Sept. We got married in august. The son was on the petition. The daughter is here she came with him. 

Do I wait til I file the AOS for my husband. I know there is a dedaline to bring the son. March 30. 

Please someone help me.

Have you contacted the embassy to inquire about the process to complete application for the son??

 

You should apply for AOS for your husband and stepdaughter that are already here.
