Some good, sound advice from our fellow VJ'ers please.   Will be filing the N-400 for my wife.  My question is, I will be sending in 2014 and 2015 Tax Return transcripts, but I need to know about the 2016 Tax Return Transcript.  I am in the process of doing our taxes and filing married, Jointly as the last previous two years, our Tax refund will be about $1312.  Now, If I filed for my wife married, but separate, her refund will be about $2800, I will receive no refund because I have been retired on Social Security Retirement, with no taxable income.

 

If I filed married , separately and filed married and separately for my wife in order to get the higher Tax Refund will that be a red flag for the USCIS when she goes in for her interview???  Any advice would be greatly appreciated.  If you suggest to get the bigger refund and file married, separately for both of us then would I send in for 2016 a tax return transcript for myself and one for my wife.

 

Please, any help would be greatly appreciated.  It is very basic, I prefer to send in the tax return transcript for 2016 as jointly so there is no question in USCIS minds.   But, the large refund my wife would get by filing married but separate is much need money for our fee plus some pocket money.    Thank you for your advice.

USCIS does NOT care if you filed jointly or separately as long as you filed as "married".  This would be a non-issue in your case.  Good luck!

Thanx Cheezees, but if this was the case then why would tax return transcripts be one of the documentations you send in for the N-400??  Also, then would I send my tax return transcript and my wife's tax return transcript along with the 2014 and 2014 joint tax return transcripts.  Thanks again

Hello, I'm not sure what your question is.  USCIS wants evidence that you filed our taxes.  It does not matter if you file jointly or separately as long as you filed as "married".  That way you can choose whichever one would get you the largest refund.  If the N-400 is being filed on the 3-year basis, I would include both of your tax transcripts.  Again, it does not matter if it is separately or jointly.  Filing "jointly" does not make you appear any more married/legitimate than filing "separately".  So as long as you both filed as married, any fears you have will be non-issues.
