Hello all,

My fiance and I are attempting to gather all the needed documentation for our interview a bit early because some of this stuff takes a while. My Fiance is currently living in Australia but is required to obtain a Canadian background check because he lived there or over a year. Does anyone know how best to go about this. From what we've been reading online we're going to have to go through a third party to get his fingerprints done and send them to the Canadian police in order to request his background check but we were wondering if there is any faster more efficient way of doing so. We've contacted the Canadian embassy in Australia and the only thing they did for us is send us to the Canadian Police website. Thanks

Country-specific thread is moved from the K-1 Process forum to the Canada regional forum.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

You do not need the fingerprint check unless your fiancé committed a crime or was otherwise arrested in Canada.  You just need what is known as a "name check".  Most of the time that is done through the local police jurisdiction where you are living or lived.  I don't know much about getting the cert from abroad as we had to pick it up in person.

Actually this is wrong in this case. The OP's Fiance is trying to get the background check from outside of Canada and for that they need the prints done.

He will need to have his fingerprints done and sent to one of the companies at this site: http://www.rcmp.gc.ca/en/who-can-conduct-criminal-record-check

It looks like it's taking about 6 months to get it back if it's ink prints so I would get on it as soon as possible, or go with one of the companies who will submit the ink prints electronically.

No. Do not do the ink prints. Do the digital prints so you can get the letter within 1-2 weeks.

The backlog on ink prints is as much as 2 years!!

Check with any background check/security firms with a digital fingerprint scanner. No 1st world country should be doing this process with ink prints.

Hi Paul. How did you guys do about the Canadian background check?
I also lived in Canada for over 6 months, so I need to get it as well. I'm very confused if I really need to get my fingerprints done, since I haven't been arrested or anything.

Thanks,

Debbie

We're about to go through the process here in the upcoming weeks. My fiance is going to be going to his local police station to get ink finger prints done and certified and will be submitting those to a company listed on the Canadian police records check website to be transferred to a digital copy to be checked by Canadian records. The results will be emailed to him and a certified copy will be mailed to him as well. Unfortunately even if you have no criminal record in Canada you still need a police check to verify you have nothing outstanding.

I don't know if I should get the fingerprints just to be safe.

I also wonder if it depends on the embassy you're going to.

We're going the just to be safe route but eventually he will be having his interview at the consulate in Sydney. He called the Canadian embassy in Australia and he was advised to check out the Canadian police's website. If you have any questions I'd probably say to give the embassy/consulate you'll be having your interview at to get any answers you need.

I will check with the embassy.  Thanks again Paul for your help!

I've heard of a lady on the same situation as mine and she went to Canada just to get the background record check! I hope I won't need to go that far...

Anyways, good luck to you guys!

Thanks Ontarkie. I emailed the embassy in Rio and they just gave me a link to the travel.us something. And in there they never exactly say what kind of police record check they want.

I guess I should be safe than sorry and get those fingerprints done.

Thanks guys!

I just went and had finger prints taken yesterday for an RCMP clearance.  Their website gives you a list of companies that will digitalize them since they only do that in Canada (I used one with Pardon in the name).  It's unfortunately not a cheap thing to do.  Most charge approx. CAD200 and then an extra cost if you want them sent back to you fast.  I'm hoping they arrive safely and all goes smoothly since it's quite the pain.  I lived there for only 11 months but Sydney Consulate has just changed their instructions for interview and want a police certificate for any country you've lived for more than 6 months, not 12 as it was.  I think this is quite common for many countries now.

The Canadian government cannot advise you on what the American government requirements... but you can find exactly what is needed on the reciprocity schedule.
