Hi, I am US citizen. I want to bring my fiance to the USA on K1 visa. He was an asylum seeker in Germany for more than 1 year (2015-2016). First, he came to UK on student visa then after completing his masters, he could not go back to home, so somehow he entered Germany 'illegally', and applied for asylum. His asylum application was not approved yet, when he found safe to travel to home, so he withdrew his application and went to back Bangladesh (his country). Here is my questions that, is he being over stayer in the UK, as they (Home Office or immigration department) don't know whether he left country or not?  Does he require police clearance letter from the both the countries, UK and Germany, for the K1? Does his asylum history going to affect his K1 visa and lastly, do we need to tell them about him asylum in Germany or can we hide it? Please give me some suggestions guys .

let me be ver clear do not try to hide or lie about anything to uscis. having fraud found against you is one of the worst things they can find.

 

as for police certificates he will need one for every country he has been in for 6 months or more. and there is no "somehow entered Germany" when asked tell them the whole truth even if illegal means we're used since that is what happened.

 

the asylum application may come up to determine how legitimate the relationship is and to make sure he is not shopping around for a place to live.

 

in short

tell the truth, the whole truth, and nothing but the truth.

He should supply all criminal certs for every country he has lived in over for 6 months or more.

 

Never lie to or "try to hide" information from immigration. That should not have even been one of your questions. 

 

If caught lying (or hiding information) he would incur a permanent ban from the US. Meaning even if he is married to a US citizen he would not be able to come. 

 

Why would you attempt to try to hide the asylum information? The K1 process takes months and during that time all the background of the applicant is investigated.

I am not trying to lie about anything but I just wanna tell our story in the best possible light.  Anyways, thanks for the reply.

I didn't mean to hide the information by the above line but wanted to know that is that important to mention this in our first application along with our "How we met" story line.
