Timeline

Hi Good Day.!!

 

Can anyone share their K1 timeline.  We are about to send our packet this march. Hope everything works smoothly. Any experiences, delay in processing, tips are highly appreciate.

12/18/2015- NOA 1

1/29/2016- NOA 2

2/18/2016- Letter from NVC saying they're forwarding to Guangzhou

3/4/2016- Received P3, returned it about a week later

3/22/2016- P4 email

5/12/16- Interview. Approved!

5/16/16- After a few days saying administrative processing, CEAC now says issued!

Additional snafu: my fiancé came over on his visa, but just a month later (and the day before we were going to get married) he had an emergency that necessitated him returning to China.  I contacted the Guangzhou consulate via their email system, provided the requested documents/proof, and he was granted a second interview for "reissuance."  He had to re-do the medical, redo the interview (bringing yet another copy of all of the things he had to bring the first time) and we were approved again!  He received what looked like a new visa in his passport, but the original 90 day countdown for marriage was still ticking.  He came back to the US and we got married right away!

8/22/16- Married!

9/30/16- Filed for AOS, EA, AP

10/6/16- NOA 1 for AOS, EA, and AP (USCIS case status website says case was received on October 4th)

11/9/16- Bio appointment

12/13/16- EA and AP approved!

no news... case status on website still says "fingerprint fee received..."

4/11/17- submitted online service request for case out of normal processing time (over 6 months)

5/2/17- USCIS website updated to "My card is being produced!"

5/10/17- Green Card received

 

 

ROC

3/2/19- Filed ROC

3/8/19- NOA/18mo extension received

5/7/19- Bio appointment

9/2/20- Interview scheduled for next month!

08/26/14 - Alien Registration Number changed.
10/17/14 RFE was received
10/23/14 RFE/I-195F mailed back to USCIS
11/05/14 I-129F Petition Approved!!!!!!!!!!!!
12/10/14 U.S. Consulate received case in the mail!!
12/19/14 Submitted DS-160 online form.
01/15/15 Submitted Package 3 Checklist for a request for interview!
01/16/15 Consulate sent me packet to prepare for my interview/medical!
02/20/15 Physical
02/24/15 Visa Interview/APPROVED!!!!!!! (6 months!!)

But unfortunately your timeline on your signature does not input the dates into Igor's lists or the prcessing times charts.

It is helpful to complete the timeline attached to your profile.

As a note you can go back into your signature and the excess spaces should be able to go.  you can also use a spoiler tag to hide it unless clicked upon.

I-129F to K1 is the usual process.

 

Another option is the I-485 for those whose fiancees are already in the country visiting. If you happen to get married while they are visiting, the I-485 can be filed for adjustment of status. The only caveat is your fiancee will not be allowed to leave the US until the I-485 is processed. 

 

I was looking at the K1 route for my then Canadian fiancee (now wife). I could not understand why my she could not stay with me in the country while the paperwork was being processed, especially since Canadians do not require a visa to visit. I made many phone calls but did not really get any good answers from the first 3 USCIS officers I spoke to. On my 4th inquiry call to USCIS, the officer I spoke to said" Look I can't really give you advice but, as a US citizen, you are free to marry anyone you choose, even if they are visitors to the United States."

 

It was all I needed to know. That was 8 years ago. I am extremely grateful to him till this day.

Yeah.. I am a worker here in Canada not Canadian. Some advise told me that it doesn't matter where I came from as long as I am legally working here in Canada. Basically I have my work permit and I did not see any problem at all. How's long did u process until  u get your wife visa.:) Hope u don't mind.

Your wife could have visited as either a wife or fiancée.  Yes you are free to marry but intending to immigrate is fraud and lying to the CBP can net someone a ban. 

 

K1 is a good route for people arent married yet, who want fast and dont care about expense, work, or travel. Also for those who have a big issue with living apart 

 

CR1 is a good route for people who want less expensive, need or want to to be able to work and travel, and can deal with a longer separation.

Perhaps I didn't go into all the details. My wife visited (left the country afterwards) numerous times while we were engaged. One of those visits we decided to get married at the courthouse. She still returned to Canada for work. I went back to Canada a few months after for a marriage celebration for families and friends. Both of us then returned to the US together.

 

I filed the I-485 adjustment of status for her. Per my understanding from USCIS from all of my phone calls, prior to doing all of this was that it was 100% legal. Otherwise without knowing any better I would have gone the K1 route for my wife.

 

Perhaps I didn't clearly articulate this in my original post, my mistake.

No, what you did was visa fraud and illegal. Your wife entered the USA with intent to immgrate and I am sure didn't tell the CBP that.  If they let her through with saying, "Hey I'm planning on moving to the USA and adjusting my status," she would be the first I've heard of that wasn't denied entry.

However, luckily for you and everyone else who does this, the USCIS cant deny you based on intent alone.

Tdot how were you able to file the AOS if she went back to Canada to work? You may be confusing that for the CR1 visa
