I'm confused... first you said "a person who is undocumented".... that means came illegally entirely.. this means no legal status even with the marriage to a USC.

 

If just overstay from like a tourist visa, then you were documented upon entry to the US on that visa. then yes marriage to a USC and AOS, the overstay would be forgiven.

08/15/2014 : Met Online

06/30/2016 : I-129F Packet Sent

11/08/2016 : Interview - APPROVED!

11/23/2016 : POE - Dallas, Texas

From sending of I-129F petiton to POE - 146 days.

 

02/03/2017 - Married 

02/24/2017 - AOS packet sent

06/01/2017 - EAD/AP Combo Card Received in mail

12/06/2017 - I-485 Approved

12/14/2017 - Green Card Received in mail - No Interview

Something is fishy here.  Is this soldier your ex-boyfriend or husband?  Are you trying to get someone into trouble here or are you really trying to help someone?

I totally agree this is the policy IF they get married and he files AOS for her. But what she is referring and asking questions about is I guess her status of being an Illegal and if it could harm him being in the Navy. I have tried to ask several times what does he do and if he has clearance but she has failed to respond back to it. Yes, it can have an affect on his clearance and if it gets yanked it would cost him his job.
