Hello,

My husband has his interview for his conditional residency on February 16th. We filed the I-130 and I 485 together. For the interview requirements, one requirement is custody papers of my children or his children. He has two children in Nicaragua, but does not have legal custody over them.

Any thoughts or guidance on this?

The  mother lives in Nicaragua and she has custody of his daughter. My husband sends money every month and have a relationship with both children, but in Nicaragua, custody papers are not something very common, to the best of my knowledge.

This makes sense. Thanks for the info. At this point, we are not applying for immigrant nor non-immigrant visas for the children. We are simply applying for his permanent residency.   

So getting legal permission for the two children to travel could be dealt with in the future, correct?

Just asked my husband. He says any official paper dealing with custody goes through the Ministerio de la Familia especially since your husband still has ties to your kids and sends them support. Unfortunately he's not a lawyer and doesn't have experience in stuff like that so that's about all he knows; but perhaps your husband has contacts in Nic who can find out what he needs. Lawyers in Nicaragua have training in a bit of everything so that's the best place to start.
