Thanks the last part is exactly what I do i chk my status and email every day. I have sentmy I 130 on May 2017 for my husband and got approved and now is Texas vista center do u know how long would it take to get any letters from them? Also we live both in Australia and we want to move back in US do u think i should be little delay for my case? Or do i have to move at least a few months earlier than him?

Thanks

From what I understand, you did not get approved yet, the Texas Service Center received your application and it is being processed.  Mine was there and took about four months but many people have waited more like 6-8 months to get NOA2 (approval for I-130 petition).  After that you would wait a couple weeks for the paperwork to be sent over to the NVC for the next step (fees, financial evidence, other supporting documents needed) and wait for another 9-11 weeks (more unfortunately if any issues arise with paperwork) for the NVC to forward everything to the embassy.  As far as moving back to the US, are you the petitioner (US Citizen/permanent resident)?  If so, at some point you will need to prove intent to reestablish domicile, basically proving that you plan to return to the US to live.  You can do this by moving ahead of him or by (I believe) actively researching jobs, housing, etc in the US and having proof of that.  I was living with my husband in his country until about a month into the NVC wait and then I returned to the US to get settled before starting my new job.  I'm a teacher so the summer is the best time for that so the timing of my move back was dictated by that.  You can always wait and see as the process continues a bit to decide when to make the move back.  Just remember that this overall process from when you submit the I-130 to finish can take an average of 9-14 months from what I have read here so take that into consideration for your planning.  Best of luck!

So  I received following checklist from NVC to submit, Looks like some of the forms are for beneficiary and some are for petitioner. They have not told they have not told which ones are for AOS and which ones are for IV.
What could be included in petitioners civil documents?  Will I submit W2s Transcripts and detailed returns for last three years or for just one year? I do not want to get RFE so want to do it right in one go InshaAllah. Please help.

May i ask if you have sent beneficiary's birth cert to USCIS when you were approved? I still have not received my NOA2.... but i hope i can help with the below...

I've been reading on other threads that people submit 3 years taxes just in case.

I think Petitioner's civil doc would mean any documents that is related to petitioner, better read through all tabs on the NVC website:

https://travel.state.gov/content/visas/en/immigrate/immigrant-process/documents/Supporting_documents.html

Petitioner Documents

If you are applying for an IR5 visa as the parent of a U.S. citizen or for an F4 visa as the brother or sister of a U.S. citizen:  You must obtain an original birth certificate for your petitioner, or a certified copy.

  • Send a photocopy of your petitioner's birth certificate to NVC.
  • Bring the original petitioner’s birth certificate plus a photocopy to your visa interview at the U.S. Embassy or Consulate.

If you are applying for an IR1, CR1, or F2A visa as the spouse of a U.S. citizen or Lawful Permanent Resident and your petitioning spouse was previously married:  You must obtain evidence of the termination of EVERY prior marriage your petitioning spouse has had. This evidence must be an original or certified copy of one of the following documents:  FINAL legal divorce decree, death certificate, or annulment papers.

  • Send a photocopy of the petitioner’s marriage termination document(s) to NVC.
  • Bring the original petitioner’s termination document(s) plus a photocopy to your visa interview at the U.S. Embassy or Consulate.

Thanks for the help. Yes I sent beneficiary's birth certificate copy.
Now as you mentioned beneficiary needs to bring petitioner's original birth certificate to interview or a certified copy of it. I think it is a good Idea to make a certified copy and send it to him now. I would go through NVC website to see what other originals or certified copies I need to send him.

Hmmm.... petitioner birth cert is only required when petitioning for parents i guess, dont remember hearing people mention anything about bringing petitioner's original anything to interview as it would then be a hassle.....

Sorry i cant help much..

Thanks for the reply so When u say 6_8 months took to get approved what do u mean of approval? Like did they ask u during this time for any additional info? Or after 6 months just started to ask u for visa pay,  sponsorship and........?if yes then  Why is taking so long to just get approval case in order to forward a case for spouse? I heard is less than 1 year to be finish. My case sent out to TSC end of May. 😑

Thanks

it's all up to USCIS how their workload is and whatnot, we as "the public" can not answer the questions why, when, etc. unfortunately there's millions of people wanting to immigrate to the US and we all just have to wait it out and be patient. it can take up to 6-8 months to be fully approved by USCIS and 9-12 months to actually getting the Visa to finally move. this is the reality  for most of the service centers.

I never changed anything on my passport after marriage and its never been an issue for me. I've entered the US 3/4 times since our wedding.

1, 2 for IV and 3 for AOS. I can not stress enough how important it is to read and follow the steps on the USCIS page for when your case goes to NVC. Civil documents for petitioner is not needed when you're just sponsoring your wife. If you are sponsoring patents then the petitioners birth certificate would be a civil documents. @DeepInLove

😩😩😩😩😩

now maybe in my panicked reading I missed something.

But when is this to take effect?

the GOP has turned in their proposal and if it ever makes it to legislation it'll take a while...
