I believe only the birth certificate for the petitioner is mandatory when there's just spouses involved. Other Birth certificates are for children born to the spouses or for other categories of family based visa aplications. I did not send in my birth certificate because it wasn't a requirement during the USCIS stage in my case. I think it might differ per country of origin of the beneficiary, but the checklist doesn't ask for it.

Yeah, It's kind of confusing. I didn't send birth certificates (just proof of citizenship) as I didn't see it in the checklist. I hope I don't get a RFE, but will be prepared just in case.

you'll need the birth certificate for NVC anyways so always good to have it already

I'll probably receive a RFE then. The good thing is they don't take that long to approve the case once they receive requested documents. I didn't send beneficiary's birth certificate as I didn't see it listen on the check list.

that's not correct at all....

 

this is what it says on I-130 instructions form:

 

Petitioner : Document to proof you are a US citizen.. could be passport, birth certificate, naturalization certificate etc ( read attached )

Beneficiary : No birth certificate is required ( read attached )

 

Attached is the instructions to the form. Nowhere it says you need to provide beneficiary's birth certificate

They requested a marriage and birth certificate from my permenant resident husband he is Appling for me and my son and we are out if the US

Well for proof of citizenship they wanted either passport or birth certificate so you should be fine if you sent copies of your passport to satisfy that. The checklist of docs required that I used when I was assembling my i130 suggested a birth certificate OR passport for beneficiary was necessary (number 7 on the list)... But as @Yeonin said it can vary depending on situation. Also I sent a copy of my passport AND birth certificate because I literally front loaded my petition as much was humanly possible. Lol.

I got a new passport but only because I wanted to change my name so that my green card would be in my married name. Mine wasnt due for renewal until like 2020 but because I was changing early due to a name change they added 6 months to the new expiration date they gave me... Something along those lines. Better to be safe than sorry though!

Ok, gotcha. The info I used to assemble my package suggested it was necessary to include but I guess it wasn't and that information is incorrect. *Shrug*

absolutely true and in my case my wife took my last name so she had to go get a new passport 😁😁😁. But it's looking like I will need a new one, I tried calling the US embassy in Amsterdam today well I got nowhere 😂 to ask for advise...i got such with the automated guy. Now I just need NVC to just hurry up with the DS260. How's your vacay going? I hope all is well.

Since NVC is sending out emails saying some people's payments haven't been made...which is not true....but antihow 🤔 they just said payments should show up online as paid either tomorrow or Monday....i guess we'll see.

Congrats. My situation is opposite .I have received email and text confirmation (USCIS website also updated as well) about approval but have not received the NOA2 letter yet. Today got another email saying that they have send my case to NVC today

Vacay is going really well. Going far too quickly though!! But still super glad to be here and happy that when I leave at the end of august it'll be the last proper goodbye eeeeeeek! :) Do you know when you'll next see your wife? P.s I didn't get any emails about payments from NVC???
