You don't have to file anything specific, it's part of the whole CR-1/IR-1 process.

When you enter the country, the stamped visa in your passport is your temporary GC.

However, they will send it to you only if you have paid the said fee (there will be a document attached to the enveloppe with the VISA).

Hey guys, after waiting for over a year I finally received my letter for the interview. (Case was received January 2nd, 2017)

I was so happy until I realized that interview in on the 22nd of this month and my husband is out of the

country in Africa until the 28th(He is the American Citizen petition for me).

 

We tried to change his flight but the cost is wayyyy outside of our budget, even

with family pitching in.

I want to reschedule but my lawyer says rescheduling has a high probability of a denial.

 

What are my chances of getting the interview rescheduled instead of my case denied?

 

I still plan on attending the interview alone in order to explain to them the situation

and provide proof of a copy of his flight ticket and passport showing that he is in Africa.

 

Is there anything else you would recommend I include as evidence that he is overseas?

Also, I moved since I filed my case and the lawyer secretary never updated my address, I recently tried to do it myself and received a letter to schedule an appointment to talk to my local immigration office. Will that have a negative effect on my case?

It has been a long time now since I filled out the DS-260 Online, I moved since then and was looking over the information I put into it. Should I update it, or would it disturb the process? I hear it takes about 3 weeks to process again. Does anyone have any experience with this? I did update my official address already, but this is specifically in the DS-260 form.

It looks like you are currently living in the US and want to Adjustment of Status right? Not sure if this is the right forum for your question, this topic is mostly about Jan 2017 fillers for I-130 - to obtain a IR1 or CR1 Spouse Visa for a non US Citizen (living overseas) married to a US Citizen.

You may continue updating an incomplete application but you cannot update a completed DS-260 form.

 

To access your application again, you need the assistance of NVC or the U.S. Embassy or Consulate at which you plan to apply. It shouldn't affect the processing time as it is just an update too a form.

I called NVC and they said that my husband can update it at the time of the interview appointment, but at this point in the case they cannot.

Also since Feb 2nd my checklist items have yet to be reviewed. So, the wait continues... I had a dream this morning that the paid status for his AOS on ceac.state.gov had changed to complete.I know it was just a dream but  I was disappointed when I checked it this morning, just in-case. That prompted the call to the NVC and since then I am trying to talk myself into being more patient with this process.

Aghhhh!! Just got an email from USCIS that says they are in the process of scheduling my "appointment " and that I should receive a new appointment notice within 60 days.  What does this mean!? 

 

Brief history: sent application Jan 2017, got an RFE in August, sent in missing info right away, was told that our case was at our local branch but would be another 180 days until we hear anything. Now on day 153 I get this email!  Please tell me this is a good thing!!!

hope you're doing well. Just thought I'd let you know that yesterday I've received a text message saying that my card is being produced. That's approximately 5 weeks from paying my immigrant fee and 4 weeks from POE.

So update on my GC - 

 

Feb 18 - status changed to "Card is being produced"

Feb 22 - status changed to "Card was mailed to me"

It's 5 Days today and nothing in the mail box... Anyone knows how long it takes? I thought, USCIS uses priority mail service.

Sorry I answered my own question! CALLED NVC and they said as of today the case is COMPLETE!!! 

 

They are just waiting for the available interview dates from the Philippine embassy to come out and they will schedule it.!

 

396 days later!

So mail with GC been in the mail box for God know how long, for some reason my wife didn't check the box until today.

Well, we were waiting for consular schedule and what we got is a nice list of what is missing from the checklist, apparently my wife, who has lived in Spain for the last 15 years, and has not worked in the US,  needs to complete affidavit of support I-864 too along with tax returns, W2 etc.  as co-sponsor along with her Sister, who is actually the person supporting us as none of us have a job there right now.

 

Also, they are asking for a bank account (no problem) and a proof of residence, (15 ye-ars-in-Sp-ain) thank god she still has the rent contract in her name but... they need proof of domicile and the bank statement and the lease have her name and address on them. 

 

Well, I wanted to ask if any other American living abroad and returning home with husband/wife knows something about these things or also had to file as a co-sponsor too.

 

For instance, how can you have a w2 when you don’t even work in the US?

Hi @Cadizfornia, we haven't got as far as you guys. Our file just got transferred to the NVC, but from my understanding even if you're living overseas, the IRS still needs you to file for taxes. You don't have to pay unless her income is over a certain amount (i.e. 100k per year amd don't quote me on that amount, this is just off memory). 

I'm a US citizen living abroad in Australia for 6 years now and have just learned this myself because of this process. I had to back track and do an Streanline Offshore form for my taxes and an FBAR. It's a lengthy explanation so you might want to so some research. Accountants charge a lot to do it for you so we ended up watching a webinar and reading a few articles and did it ourselves but it is very time consuming. Good luck!
