Question about I 864 adjustment of status

Hello friends of visa journey!

 

Well my wife and I have been working really hard for the last 3 months  gathering all the documents and filing out all the forms for our AOS package.  

 

This website has helped me a lot. Very nice members always willing to share their experience to help others on their applications.

 

Now I'm really confused about how the form I 864 works we have attempted several times for the last 2 months to have  a friend or a family member to be our joint sponsor (We have lost several friends) . We already gave up on the idea of asking our family because they have turned their backs on us and there is very little we can do about it. We talked to our lawyer last December and he said that the only solution was for her the sponsor\petitioner to get a  job with more hours and better wage  at least while we are in the process and then we could use her latest pay stubs and a letter from her employer as a proof of income to submit our application. Now she has a full time job and we already have the letter from her employer and the pay stubs for january . But here is our concern, she was unemployed for the year 2014 and 2015 because she was a student last year 2016 she only made around $3000. So we worried that we might receive an RFE because of the lack of income for the last 3 years. Or will it be enough to prove that her income will be more substantial this year (above poverty guideline).???

I'm also kind of in same situation. My family turned their back on me because they didn't approve my marriage. We just submitted our i-130 2 weeks ago. I learned that you can use ANYONE as a sponsor. So ask her if she can get any of her friends parents can be a sponsor.

Hey I totally understand how it can be with family members at times, My one question is: Does she make enough right now to sponsor you on her own? If yes, all you need are:

1) A letter from your wife simply explaining what you said about her being a student and if she didn't file taxes for those years because she wasn't required to because she didn't make enough, simply state that as well, date it and let her sign it.

2) A letter from her job stating: start date, her position/job description, if she's full/part time and annual salary,

3) The last 3-6 months of pay stubs (preferably 6 months if possible).

Now if she does not meet the minimum requirement then she would need a joint sponsor which doesn't have to be a family member, any friend/associate can do this. Once you have this person, let them fill out form I-864 as the ONLY JOINT SPONSOR and attach number 2 and 3 from above with last 3 years of tax transcript and copy of their US passport/Birth certificate or Greencard (front and back) to prove citizenship or legal permanent residency.

PLEASE NOTE that your wife is still REQUIRED to send her form I-864 even along with the one for the joint sponsor with all the evidence of 1-3 above.

▪12/19/2016: AOS & EAD/AP mailed. (Day 00)

▪12/21/2016: Package signed for at Chicago Lockbox. (Day 02)

▪01/06/2017: Text/Email notification of acceptance confirmation from USCIS. (Day 18)

▪01/10/2017: Physical mail NOA received. (Day 22)

▪01/21/2017: Received Biometrics Appointment via mail (Bio. Appointment 01/30/2017). (Day 33)

▪03/01/2017: EAD/AP approved/sent for production. (Day 70)

▪03/06/2017: Received approval receipts by mail for both EAD & AP. (Day 75)

▪03/08/2017: Received EAD/AP combo card. (Day 77)

▪11/25/2017: Received Green card in mail. (Day 339)
