Hello everyone, hopefully someone can help me out with this confusing email letter from NVC. I attached couple screen shots of the letter.

 

My wife wants to petition her mom to live in the US, she doesn't work, no income, I am the only one is working, we file jointly on tax, 1 son, total 4 household members including my mom in-law. According to 2016 HHS Poverty Guideline, minimum income for 4 people is $30,375. We sent two I-864 (not I-864a) forms, one for my wife and another one for me as a Joint Sponsor. I sent in the most recent year tax return and the income total for 2015 is $38,848.

 

Now I am so confused, my income is exceeding the required minimum income guideline. Why did they send me a letter saying that I do not meet the minimum income? Also, why do they want me to make correction on the   

I-864A which I did not submit at all?  I just got my W-2 for 2016, it's about the same amount as 2015. Am I missing something or misinterpreted the HHS Poverty Guideline?  They want me to send the missing document to my mother in-law.

You incorrectly sent in the I-864 for both you and your wife.  As a married couple it would be more appropriate for the I-864 from whichever of you is the main sponsor and the I-864a as the household member from the other person.

Thanks, I thought since i will be the joint sponsor, I need to submit the I-864 also. I can't be a joint sponsor if I m a husband of the petitioner? So I just need to fill out and send a new I-864a to my mother in-law then? Is my income be enough for 4 people in this case?

So all I need to send to my mother in-law is the new I-864 (my wife), my I-864a, and other required documents?  Since my income is well aboe the HHS guideline,there shouldn't be a problem on the financial support part right?

No it shouldn't be a problem, and no you can't be the joint sponsor as her spouse, you need to be the household member.
