Hello friends of visa journey!

 

Well my wife and I have been working really hard for the last 3 months  gathering all the documents and filing out all the forms for our AOS package.  

 

This website has helped me a lot. Very nice members always willing to share their experience to help others on their applications.

 

Now I'm really confused about how the form I 864 works we have attempted several times for the last 2 months to have  a friend or a family member to be our joint sponsor (We have lost several friends) . We already gave up on the idea of asking our family because they have turned their backs on us and there is very little we can do about it. We talked to our lawyer last December and he said that the only solution was for her the sponsor\petitioner to get a  job with more hours and better wage  at least while we are in the process and then we could use her latest pay stubs and a letter from her employer as a proof of income to submit our application. Now she has a full time job and we already have the letter from her employer and the pay stubs for january . But here is our concern, she was unemployed for the year 2014 and 2015 because she was a student last year 2016 she only made around $3000. So we worried that we might receive an RFE because of the lack of income for the last 3 years. Or will it be enough to prove that her income will be more substantial this year (above poverty guideline).???

Current income matters more than anything else, however if she has a better job, I suggest she keep it since living in the USA isn't cheap by any stretch of the imagination.

You are confusing two different issues, to file taxes and meet current income requirements.

Does that mean that we will be ok if we submit her current pay stubs and letter along with the I 864 ?

I cannot guarantee anything like that.  But if I were in your shoes, and the employment had been at least 6 months, I would try.

My husband did not file taxes a couple years ago due to being in school, and when we filled out the forms the very last page provides additional space for explanations. So we just put in that he was in school, and did not have to file taxes that year. Mind you we didn't file that long ago, but so far we have received no RFE. Also we attached a few of his pay stubs, and a letter from his employer stating his job, income, and when he initially started working there. The instructions didn't say to add all that, but I just wanted to fluff it up a bit just to hopefully avoid any RFE. Cheers.

AOS Package received: 12/22/2016

Fees accepted: 01/05/2017

NOA email received: 01/09/2017

NOA letter received: 01/13/2017 (dated 01/06/2017)

Biometrics appointment letter received: 01/21/2017 (dated 01/14/2017)

Biometrics appointment date: 01/30/2017

Case status changed to ready to schedule interview: 02/10/2017

EAD card status changed to being produced: 03/24/2017

EAD card sent in the mail 04/03/2017

Interview scheduled for: 05/10/2017 (Case status changed on 04/04/2017)
